R-14-40 RESOLUTION NO. R-14-40 RESOLUTION TO APPROVE THE REQUEST BY NAVY FEDERAL CREDIT UNION,APPLICANT, AND RICHARD W. PEPPER, AGENT, FOR A SPECIAL EXCEPTION FOR RELIEF FROM THE DEVELOPMENT STANDARDS SET FORTH IN SEC. 110-180 (b) (2) a 2 OF THE CITY ZONING ORDINANCE, FOR A TENANT SPACE LOCATED AT 11180-82 LEE HIGHWAY,AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-1-02-016. WHEREAS, Navy Federal Credit Union, Applicant, and Richard W. Pepper, Agent, has submitted Application No. SE-14060018 requesting a Special Exception to modify the requirements of City Code 110-180(b)(2) a 2 to allow a tenant sign on a non-frontage facade of a shopping center building. WHEREAS, City Council has carefully considered the application, the recommendation from Staff, and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exceptions would be appropriate because the proposal would meet the requisites established by City of Fairfax Code §110-185 and 110-366 and for the following reasons: 1. The applicant has demonstrated that the sign requirements contained in Section 110- 180(b)(2) a 2 will present a unique burden due to the tenant's location in the shopping center relative to the existing site's points of vehicular access; 2. The request is consistent with the comprehensive plan and other adopted city goals and policies; 3. The request is appropriate given the size and shape of the lot and the lot's site design on which the use is proposed; 4. The request will not result in increased traffic congestion or otherwise negatively impact existing traffic flow or pedestrian and vehicular safety; 5. The request will not be contrary to the objectives specified in the comprehensive plan; 6. The request will not adversely impact adjacent property or the surrounding area; 7. The request will not adversely impact the safety and welfare of residents living in the area; and 8. The request is in harmony with the general purpose and intent of the applicable article of Chapter 110 of the City Code. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 22nd day of July, 2014, that Application No. SE-14060018 be and hereby is APPROVED, as requested with the following conditions: 1. The proposed signage and lighting shall be in general conformance with the exhibits included with the application by Navy Federal Credit Union, as revised through April 15, 2014. 2. The total area of all building-mounted signage for this tenant space shall not exceed 80 square feet. 3.
