AN ORDINANCE AMENDING CHAPTER 90, ARTICLE II, DIVISION 4,
SECTION 90-109, OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA,
PERTAINING TO PARTIAL REAL ESTATE PROPERTY TAX EXEMPTIONS FOR
CERTAIN REHABILITATED, RENOVATED OR REPLACEMENT RESIDENTIAL
STRUCTURES, AND REPEALING CHAPTER 90, ARTICLE II, DIVISION 5 OF
THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, PERTAINING TO PARTIAL
REAL ESTATE PROPERTY TAX EXEMPTIONS FOR CERTAIN
SUBSTANTIALLY REHABILITATED COMMERCIAL STRUCTURES.
BE IT ORDAINED, by the City Council of the City of Fairfax, Virginia, that Chapter
90, Article II, Division 4, Section 90-109, of the Code of the City of Fairfax, Virginia,
pertaining to partial real estate property tax exemptions for certain rehabilitated, renovated or
replacement residential structures, is hereby amended as follows:
"Sec. 90-109. - Applicability to rehabilitation commencing before enactment of
division; expiration of division.
An owner may apply for an exemption if a building permit for the proposed
rehabilitation was issued on or after January 1, 1994. In addition, and notwithstanding
anything to the contrary in this division or elsewhere in applicable law, only exemptions
granted under the provisions of this division on or prior to December 31, 2014, or for which
applications were fully and completely filed with the city on or prior to that date and then
subsequently granted by the city pursuant to the terms of this division, shall be lawful."
BE IT FURTHER ORDAINED, by the City Council of the City of Fairfax, Virginia,
that Chapter 90, Article II, Division 5 of the Code of the City of Fairfax, Virginia, pertaining
to partial real estate property tax exemptions for certain substantially rehabilitated commercial
structures, is hereby deleted in its entirety.
This ordinance shall become effective as provided by law.
