AN ORDINANCE GRANTING A LICENSE TO THE BRECKINRIDGE LANE
HOMEOWNERS ASSOCIATION, INC., TO USE FOR THE TERM AND UPON THE
CONDITIONS STATED HEREIN THE PUBLIC RIGHT-OF-WAY IN THE CITY OF
FAIRFAX,VIRGINIA FOR MAINTENANCE OF AN IMPROVED ENTRANCE
FEATURE AND A BRICK BORDERED PLANTER AREA WITHIN THE CITY'S
RIGHT-OF-WAY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX,
VIRGINIA (hereinafter referred to as "CITY") that the BRECKINRIDGE LANE
HOMEOWNERS ASSOCIATION, INC., (hereinafter referred to as "Breckinridge HOA") for
a period of five (5) years commencing on January 1, 2014 and ending at 11:59 p.m. ET on
December 31, 2019, subject to the conditions and restrictions herein stated, is hereby
authorized and empowered on a non-exclusive basis to install, construct and maintain
improvements within the CITY's Breckinridge Lane right-of-way within the corporate limits
of the CITY, as the same now exists or may hereafter be extended or altered, for the purpose
of installing and maintaining an improved entrance feature and a brick-bordered planter area,
and similar features.
BE IT FURTHER ORDAINED by the City Council of the CITY that the City
Manager is authorized and directed to execute a License containing the terms and conditions
contained herein and substantially of the form attached to this ordinance as Exhibit "A"
subject to the concurrence of the City Attorney.
This ordinance shall become effective as provided by law.
