RESOLUTION TO APPROVE THE REQOERSS ECIAL EXCEPT IONS FOR RELIEF
OWNER OF THE GREENE TURTLE,
FROM THE DEVELOPMENT STANDARDS SET FORTH IN ARTICLE II,
DIVISION 7 (SIGNS) OF THE CITY PARTICULARLY DESCRIBED AS LOCATED TAX AT 3950
MAP
UNIVERSITY DRIVE, AND MORE P RTICUL
PARCEL 57-2-43-B2-202.
WHEREAS,Larry LeDoyen, Managing Member for GT Old Town Fairfax LLC, has
submitted Application No. SE-13080014 requesting Special Exceptions to:
1. Modify the requirements of City Code 110-180(b)(2)b.4.i to increase the maximum
cumulative total of tenant signage; and
2. Modify the requirements of City Code §110-180(b)(2)b.4.ii to allow five awnings with
signage and one building-mounted sign higher than the permitted 3.5 feet above the
finished floor level of the second story
WHEREAS, City Council has carefully considered the application, the
recommendation from Staff, and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exceptions
would be appropriate because the proposal would meet the requisites established by City of
Fairfax Code §110-185 and 110-366 and for the following reasons:
1. The applicant has demonstrated that the sign requirements contained in Section
l 10-180(b)(2)b.4.i and 110-180(b)(2)b.4.ii will present a unique burden due to
the restaurant's location in the multistory building;
2. The request is consistent with the comprehensive plan and other adopted city
goals and policies;
3. The request is appropriate given the size and shape of the lot and the lot's site
design on which the use is proposed;
4. The request will not result in increased traffic congestion or otherwise
negatively impact existing not be t

comprehensive plan;
6. The request will not adversely impact adjacent property or the surrounding
area;
7. The request will not adversely impact the safety and welfare of residents living in the
area; and
8. The request is in harmony with the general purpose and intent of the applicable article
of Chapter 110 of the City Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 12th day of November, 2013, that Application No. SE-13080014 be and
hereby is APPROVED, as requested with the following conditions:
1. The proposed awnings and building-mounted sign shall be in general conformance
with the exhibits included in the application by GT Old Town Fairfax, on August 02,
2013 and revised through September 05, 2013.
2. The total area of all building-mounted signage shall not exceed 175 square feet.
