AN ORDINANCE EXTENDING, THROUGH MARCH 31, 2014, THE FRANCHISE
GRANTED TO COXCOM, LLC DB/A COX COMMUNICATIONS NORTHERN
VIRGINIA (SUCCESSOR IN INTEREST TO MEDIA GENERAL CABLE OF
FAIRFAX COUNTY, INC.) BY ORDINANCE ENACTED ON NOVEMBER 24, 1998
(ORDINANCE NO. 1998-35),AS AMENDED BY ORDINANCE ENACTED ON JULY
27, 1999 (ORDINANCE NO. 1999-22).
WHEREAS, Ordinance No. 1998-35, adopted by the City Council of the City of Fairfax,
Virginia, granted to Media General Cable of Fairfax County, Inc. for a period of fifteen (15)
years the right to operate and maintain a cable system within the corporate limits of the City
of Fairfax; and
WHEREAS, Ordinance No. 1999-22, adopted by the City Council of the City of Fairfax,
Virginia, amended the franchise to reflect the acquisition of the local assets of Media General
Cable by CoxCom, LLC ("Cox"); and
WHEREAS, the City is in the process of considering a new ordinance to award a new
franchise and may not finalize this process before December 13, 2013, the current expiration
date of the existing franchise; and
WHEREAS, the City and Cox both desire to reserve their respective rights under state and
federal law, including, without limitation, 47 U.S.C. § 546.
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Fairfax,
Virginia, that the franchise granted by Ordinance No. 1998-35, as amended by Ordinance No.
1999-22, be and hereby is extended through March 31, 2014.
This ordinance shall become effective as provided by law.
