RESOLUTION TO DENY THE REQUEST BY MICHAEL ROSKIND, 1'OR A
SPECIAL EXCEPTION TO REDUCE THE CANOPY COVERAGE ON A 1OT IN
THE R-2 RESIDENTIAL DISTRICT ON THE PREMISES KNOWN AS 10512 OAK
PLACE AND MORE PARTICULARLY DESCRIBED AS TAX MAP 47-4-03-046.
WHEREAS, Michael Roskind, has submitted Application No. SE-1 120047
a
requesting S ecial Exception to Sec. 110-255(3) to reduce the canopy coverage required for
p P
a residential lot; and
WHEREAS, City Council has carefully considered the application, the
recommendation from Staff and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Excepti n is not
appropriate because the proposal does not meet the requisites established by City off Fairfax
Code Sections 110-263 and 110-366 for the following reasons:
• The applicant has failed to demonstrate a situation of extreme topography''
unusual lot shape or extraordinary circumstance that would prevent the
applicant from providing additional tree canopy coverage.
• The request is inconsistent with the Comprehensive Plan and other adopte4
goals and policies.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 28th day of May, 2013, that Application No. SE-12120047 be and hereby is
DENIED.
