R-13-11 RESOLUTION NO. R-13-11 RESOLUTION TO APPROVE THE PURSUANT TO CITY CODE PROPERTY ON 110 185 TO FOR A SPECIAL EXCEPTION PUR NT ALLOW A TENANT SIGN AT A HEIGHT GREATER THAN 3.5 FEET ABOVE THE FINISHED FLOOR LEVEL PREMI O SES KNOWN AS 030 OF PLACE MULTISTORY OFFICE BUILDING ON THE AND MORE PARTICULARLY DESCRIBED AS TAX MAP 47-4-02-02-02. WHEREAS, Liberty Property Trust, has submitted Application No. SE-13020062 requesting a Special Exception to Sec. 1 10-180 (of the second story of a multistory sign tist y height office a greater than 3.5 feet above the finished floor level building; and WHEREAS, City Council has carefully considered the application, the recommendation from Staff, and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal, as modified by the conditions of approval, meets the requisites established by City of Fairfax Code Sections 110-185 and 110-366 for the following reasons: 1) The applicant has demonstrated that the sign requirements contained in Section 110- 180(b)(2)a.1 will present a unique burden due to the long and narrow shape of the lot and the location of the primary site entrance at one end; 2) The request is consistent with the Comprehensive Plan and other adopted city goals and policies; 3) The request is in harmony with the purpose of the sign article set forth in Section 110- 176 of the City Code and the purposes of zoning ordinances set forth in Code of Virginia 15.2-2283; and 4) The request will not adversely impact adjacent property or the surrounding area. NOW, THEREFORE, BE IT tRESOLVED by No. SE Council of the City and hereby�s Fairfax on this 14th day of May, 2013, Application APPROVED, with the following condition: 1. The sign shall be in general conformance with the sign exhibit included in the application by Liberty Property Trust received on February 12, 2013. ADOPTED this 14`" day of May, 2013.
