Resolution Establishing Voting Record of City Council DRAFT - SECOND REVISION
WHEREAS, A majority of City Council deems it to be in the best interest of its
individual and collective membership and of the body politic it represents to adopt
lawful rules of order governing council proceedings and based on a recognized and
generally accepted work on parliamentary procedure and practice, so as to assist said
Council in accomplishing its functions in an orderly and facile manner; and
WHEREAS, It is the sense of a majority of City Council that there be absolute
clarity with respect to the individual voting records of each of its members on all
matters or actions of said Council requiring a vote; therefore, be it
RESOLVED, That City Council, by majority vote of its members as indicated in the
addenda hereto, hereby adopts as its lawful rules of order, in accordance with which it •., {
shall be guided and governed in the proceedings of its 1964-66 Session, that work on
parliamentary law known as Robert's Rules of Order Revised, Seventy-fifth Anniversary
Edition; except that in the event of any lawfully-sustained conflict therewith, then and
in that event applicable rules in accordance with the Provisions of City Charter or
general law shall take precedence; and with the further exception that, anything con-
tained in Robert's Rules, City Charter or general law to the contrary notwithstanding,
the minutes of said Council and any or all other written records of its proceedings shall
represent clearly the action of each Councilman present with respect to the abstentions,
ayes and noes on all matters requiring a vote of the Council; and the Council shall so
govern itself and be governed accordingly; and further, be it
RESOLVED, That nothing herein shall be construed as limiting or abridging the right
of City Council, within the limits of its then-existing lawful rules of order, to amend,
supplement, rescind or replace any or all of said lawful rules of order from time to
time as in its discretion it may see fit; and further, be it
RESOLVED, That no alleged error or infraction thereof with respect to its lawful
rules of order on the part of City Council or any of its members shall be construed or
used in any way by any Councilman to invalidate, rescind, hinder or obstruct any action -
or proceeding of said Council unless concurred in by a majority of said Council, or f "
unless such alleged error or infraction be noted, contested and sustained in accordance
with the lawful rules of order at the same meeting of Council during which it allegedly
occurs; except that in the event of any lawfully-sustained conflict between any provision
of City Charter or general law and any provision of this resolution, then and in that
event such provision of this resolution shall give way thereto and become null and void,
but no such nullification of any provision hereof shall affect the validity of this
resolution as a whole or any other part hereof; and further, be it
RESOLVED, That a copy of this resolution and its preamble together with a record of
the Council votes thereon, as addenda hereto, be spread upon the record of the proceed-
ings of this Council by its Clerk by entering same in the minutes of the regular meeting
of City Council duly called and assembled in chamber on October 7, 1964.
