2012-13 ORDINANCE NO. 2012-13 AN ORDINANCE EXTENDING FOR NINETY (90) DAYS THE FRANCHISE GRANTED TO VIRGINIA ELECTRIC AND POWER COMPANY BY ORDINANCE ON JULY 20, 1982 (ORDINANCE NO. 1982-24) WHEREAS, Ordinance No. 1982-24, adopted by the City of Fairfax, Virginia (the "City") on July 20, 1982, granted to Virginia Electric and Power Company for a period of thirty (30) years from and after the final passage of said ordinance the right to use the streets, alleys, and public places of the City to acquire, erect, install, maintain, and use, and if now constructed to maintain and use, poles, towers, wires, cables, conduits, ductways, manholes, handholds, and appliances, in, over, along, on, and under the streets, alleys, and public places of the City, for the purpose of distributing, transmitting, and selling electric current for light, heat, and power at any point within the corporate limits of the City; and WHEREAS the City is in the process of considering a new ordinance to award a new franchise and may not finalize this process before July 19, 2012; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Fairfax, Virginia that the franchise granted by Ordinance No. 1982-24 is hereby extended by ninety (90) days until and through October 17, 2012. This ordinance shall become effective as provided by law.
