AN ORDINANCE AUTHORIZING THE ACQUISITION AND POSSIBLE
CONDEMNATION (INCLUDING THE USE OF "QUICK TAKE" PROCEDURES)
OF A PORTION (APPROXIMATELY 2.33 ACRES) OF CERTAIN REAL
PROPERTY OWNED BY TRMI HOLDINGS, INC.,LOCATED GENERALLY AT
3800 PICKETT ROAD,FAIRFAX,VIRGINIA, AND HAVING TAX MAP NO. 57-1-
02-009
WHEREAS,the City has determined that there is a public need to acquire certain real
property, and to construct a school bus parking lot and related appurtenances, in order to relocate
school buses from the former Eleven Oaks property in the City (the "Project"); and
WHEREAS,the property identified by the City as the location for the Project is an
approximately 2.33 acre portion of property owned by TRMI Holdings, Inc. (the "Owner"), locate' at
3800 Pickett Road, Fairfax, Virginia, and having Tax Map No. 57-1-02-009 (the "To Be Acquired
Property"); and
WHEREAS, the City has engaged a licensed appraiser to value the To Be Acquired Prope y;
and
WHEREAS, the City has held a public hearing regarding the To Be Acquired Property
pursuant to Virginia Code § 15.2-1903; and
WHEREAS,the City and the Owner have been unable to reach agreement on the valuatio
for the To Be Acquired Property; and
WHEREAS, due to the deadlines imposed in conjunction with the Project, the initiation o
condemnation proceedings, to include the utilization of"quick take" procedures, is necessary.
NOW,THEREFORE,BE IT ORDAINED,by the City Council of the City of
Fairfax, Virginia,that acquisition of the To Be Acquired Property is necessary for the Project,
for the reasons set forth in this ordinance, and staff is hereby authorized to acquire the To Be
Acquired Property, including by the initiation of condemnation proceedings and possession
prior to the institution of the condemnation proceedings, in accordance with applicable law.
This ordinance shall become effective as provided by law.
