R-12-16 RESOLUTION NO. R-12-16 RESOLUTION TO APPROVE THE REQUEST BY JDC BOULEVARD, LLC,FOR A SPECIAL EXCEPTION PURSUANT TO CITY CODE SECTION 110-185 TO ALLOW A SHOPPING CENTER IDENTIFICATION SIGN IDENTIFYING INDIVIDUAL BUSINESSES ON THE PREMISES KNOWN AS 10120-10160 FAIRFAX BOULEVARD AND MORE PARTICULARLY DESCRIBED AS TAX MAP 47-4-23 PARCELS 000A AND 000D. WHEREAS,JDC Boulevard, LLC, has submitted Application No. SE-12030048 requesting a Special Exception to Sec. 110-180(b)(2)a.1 to allow a shopping center identification sign identifying individual businesses; and WHEREAS, City Council has carefully considered the application, the recommendation from Staff, and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal, as modified by the conditions of approval, meets the requisites established by City of Fairfax Code Sections 110-185 and 110-366 for the following reasons: 1) The applicant has demonstrated that the sign requirements contained in Section 110- 180(b)(2)a.1 will present a unique burden due to the long and narrow shape of the lot and the location of the primary site entrance at one end; 2) The request is consistent with the Comprehensive Plan and other adopted city goals and policies; 3) The request is in harmony with the purpose of the sign article set forth in Section 110- 176 of the City Code and the purposes of zoning ordinances set forth in Code of Virginia 15.2-2283; 4) The request will not negatively impact traffic flow or pedestrian and vehicular safety; and 5) The request will not adversely impact adjacent property or the surrounding area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 8th day of May, 2012, that Application No. SE-12030048 be and hereby is APPROVED,with the following condition: 1. The sign shall be in general conformance with the sign exhibit prepared by Bignell Watkins Hasser dated March 15, 2012. 1 r - Mayor ATTEST: 9 ,.
