RESOLUTION NO. R -12 -12
A RESOLUTION APPROVING AN AGREEMENT OF PURCHASE AND SALE
BETWEEN THE CITY OF FAIRFAX AS PURCHASER AND THE ECONOMIC
DEVELOPMENT AUTHORITY OF THE CITY OF FAIRFAX AS SELLER, FOR
CERTAIN REAL PROPERTIES LOCATED IN THE CITY OF FAIRFAX AND
IDENTIFIED AS TAX MAP NO. 57 -4 -2 -115 AND TAX MAP NO. 57 -4 -2 -116
WHEREAS, the City of Fairfax, Virginia (the "City ") has determined that certain
improvements to Old Town Square /Kitty Pozer Garden are desirable (the `'Project "); and
WHEREAS, in connection with the Project, the City Council has made the determination that
it is in the best interest of the City to acquire certain real properties owned by the Economic
' : Development Authority of the City of Fairfax, and more particularly identified as Tax Map
No. 57 -4 -2 -115 and Tax Map No. 57 -4 -2 -116, and to utilize excess bond proceeds for said
: # acquisition, as permitted by the bonding documents.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax,
Virginia, that the City Manager is authorized to negotiate and execute an Agreement of
Purchase and Sale, substantially of the form attached to this resolution as Exhibit "A ", subject
to the concurrence of the City Attorney; and
BE IT FURTHER RESOLVED by the City Council of the City of Fairfax, Virginia, that the
'I City Manager and the City Attorney are hereby authorized to execute and deliver any
documentation required in connection with the Agreement of Purchase and Sale in order to
1 consummate the transactions contemplated thereby and by this resolution.
