RESOLUTION TO APPROVE THE REQUEST BY GT OLD ON FOR FOR C,
OWNER OF THE GREENE TURTLE, FOR SPECIAL EXCEPTIONS
FROM THE DEVELOPMENT STANDARDS SET FORTH IN ARTICLE 11,
DIVISION 7 (SIGNS) OF THE CITY ZONING
DESCRIBED AS T TAX AT 3950
MAP
UNIVERSITY DRIVE, AND MORE PARTICULARLY
PARCEL 57- 2 -43 -B2 -202.
WHEREAS, Larry LeDoyen, Managing Member for GT Old Town Fairfax LLC, has
submitted Application No SE- 12020150 requesting Special Exceptions to
1. Modify the requirements of City Code §110- 180(b)(2)b.4.ii to allow two building-

: : mounted signs higher than the permitted 3.5 feet above the finished floor level of the
second story; and
2. Modify the requirements of City Code 110- 180(b)(2)b.4.i to allow signage to be
displayed on patio umbrellas.
WHEREAS, City Council has carefully considered the application, the
recommendation from Staff, and testimony received at the public hearing; and
' WHEREAS, City Council has determined that the proposed Special Exceptions

would be appropriate because the proposal would meet the requisites established by City of
I Fairfax Code §1 10 -185, and for the following reasons:

1. The request is consistent with the comprehensive plan and other adopted city
ii goals and policies;
i 2. The request is appropriate given the size and shape of the lot and the lot's site
I design on which the use is proposed;
3. The request will not result in increased traffic congestion or otherwise
negatively impact existing traffic flow or pedestrian and vehicular safety;
4. The request will not be contrary to the objectives specified in the
comprehensive plan;
5. The request will not adversely impact adjacent property or the surrounding
area;
6. The request will not adversely impact the safety and welfare of residents living in the
area; and
7. The request is in harmony with the general purpose and intent of the applicable article
of Chapter 110 of the City Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 27 day of March, 2012, that Application No. SE- 12020150 be and hereby
is APPROVED, as requested with the following conditions:
1. The two building- mounted tenant signs shall be in accordance with the Special
Exception Plan revised through February 1, 2012.
2. The signage to be displayed on patio umbrellas shall be in accordance with the Special
Exception umbrella specifications dated March 6, 2012.
3. The total area of building- mounted signage shall not exceed 83.7 square feet.
