R-12-08 RESOLUTION NO. R -12 -08 i'. APPROVAL OF PERIMETER LANDSCAPING, PERMANENT SIGNAGE AND TEMPORARY SIGNAGE RESOLUTION TO APPROVE THE REQUEST FOR PERIMETER LANDSCAPING. PERMANENT SIGNAGE AND TEMPORARY SIGNAGE BY TURNPIKE LLC, OWNER, ( FOR SPECIAL EXCEPTIONS FOR RELIEF FROM THE DEVELOPMENT STANDARDS SET FORTH IN FOUR SECTIONS OF THE CITY ZONING ORDINANCE ON THE PROPERTY KNOWN AS TAX MAP PARCEL 58- 03- 02 -028A AND ALSO KNOWN AS 9500 -9580 MAIN STREET. 1' WHEREAS, Molly Novotny, as Agent for Turnpike LLC, Owner, has submitted Application No. SE -1 1120045 requesting Special Exceptions to: 1. Modify the requirements of City Code Section 110 -180 (b)(2) a. 2. i to allow building mounted signage on one store that exceeds the 150 square foot limit; i s 2. Modify the requirements of City Code Section 110- 180(b)(2)a. 2. to allow building mounted signage on walls not defined as building frontage on tenant units located on the east corner of the subject building; 3 s 3. Modify the requirements of City Code Section 110 -182 (4) to allow temporary signage that exceeds the 32- square foot size limitation and 3 -month duration; and 4. Modify the perimeter parking landscaping requirements of City Code Section 110- 259a(1) a by allowing the existing landscape strip along Main Street to remain and permitting a new landscape strip along the new parking section on Pickett Road to be Tess dense than what is required. WHEREAS, City Council has carefully considered the application, the recommendation from Staff, and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exceptions for perimeter landscaping, permanent signage and temporary signage with some limitations would be appropriate because the proposal would meet the requisites established by City of Fairfax Code Sections 110-366, 110 -263, and 110 -185, and for the following reasons: 1. The request is consistent with the comprehensive plan and other adopted city goals and policies; 2. The request will not adversely impact the safety and welfare of residents living in the area; 3. The applicant has demonstrated that there is a unique burden due to unusual topography, vegetation, building design or lot shape requiring relief to the signage requirements; and 4. The request is in harmony with the general purpose and intent of the applicable article of Chapter 110 of the City Code. Now, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 13 day of March, 2012, that Application No. SE- 11120045 be and hereby is APPROVED for perimeter landscaping, permanent signage and temporary signage, as requested with the following conditions: 1. The site plan shall be in substantial conformance with the approved Special Use Permit /Special Exception Plan dated November 21, 2011 and revised through March 1, 2012. 2. The building - mounted identification sign above the entrance doors to the Ross store shall not exceed 200 square feet. The two under canopy signs shall not exceed eight square feet each. 3. No more than 18 months after issuance of Non - Residential Use Permit for the "big box" retail store, improvements to the architectural facade of the entire main structure of the shopping center as approved by City Council shall be complete, the Comprehensive Sign Plan shall have been approved by the Board of Architectural Review, and installation of the monument sign for the shopping center shall be complete. 4. The proposed architecture for the center shall be generally as depicted by the applicant's graphic labeled "Alternative 1. 5. All dumpsters serving the new stores fronting Pickett Road shall be enclosed per the City Code standard. 6. Temporary signage shall be permitted, however it shall not exceed the 32 square foot size limitation and shall not be in place for longer than six (6) months. Further, no bunting shall be permitted.
