RESOLUTION TO APPROVE THE REQUEST OF AL -FOODS LLC DBA CURRY
MANTRA BY ASAD SHEIKH, OWNER/MANAGER, 110-- 158TOFREDUCE THE AMOUNT O
PURSUANT TO CITY CODE SECTION
REQUIRED PARKING ON THE PROPERTY KNOWN AS TAX MAP PARCELS 58-
3 -02 -000 -E AND 58 -3 -02 -000 -F AND ALSO KNOWN AS 9984 AND 9988 MAIN
STREET.
WHEREAS, AL- Foods, LLC dba Curry Mantra by Asad Sheikh , Owner /Manager,
has submitted Application No. SE- 11110009 requesting a Special Exception to reduce the
requirements of Section 110 -155, which defines required off- street parking.
WHEREAS, City Council has carefully considered the application, the
recommendation of staff, and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exception is
appropriate because the proposal meets the requisites established by City of Fairfax Code
Section 110 -366 and 110 -158 for the following reasons:
1) The request will not result in increased traffic congestion or otherwise
negatively impact existing traffic flow or pedestrian and vehicular safety;
2) The request will not be contrary to the objectives specified in the
comprehensive plan;
i 3) The request is the minimum necessary to afford relief;

I 4) The request will not adversely impact the safety and welfare of residents living in the

I area; and
1 5) The request is in harmony with the general purpose and intent of the applicable article
of Chapter 110 of the City Code.

1 1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
i Fairfax on this 24 day of January, 2012, that Application No. SE-11110009 be and hereby is
i APPROVED to allow the applicant the ability to reduce the amount of required parking for
the corresponding proposed increase in dinner -only seating to 106 seats, subject to the
following condition:
1. Curry Mantra's seating capacity shall be allowed to increase from 56 seats to 106 seats
from 5 pm to 10 pm only, Monday through Sunday.
