AN ORDINANCE GRANTING A LICENSE TO THE CHANCERY
PARK HOMEOWNERS ASSOCIATION, TO USE FOR THE TERM
AND UPON THE CONDITIONS STATED HEREIN THE PUBLIC
RIGHT -OF -WAY IN THE CITY OF FAIRFAX, VIRGINIA FOR
INSTALLATION AND MAINTENANCE OF IMPROVEMENTS
WITHIN THE PUBLIC RIGHT -OF -WAY, AND SPECIFICALLY, A
TRAFFIC ISLAND IN CHANCERY PARK DRIVE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX,
VIRGINIA (hereinafter referred to as "City ") that the CHANCERY PARK
HOMEOWNERS ASSOCIATION (hereinafter referred to as "CHPA ") for a period of
five (5) years commencing on the date of expiration of the current license agreement
between the parties, subject to the conditions and restrictions herein stated, is hereby
authorized and empowered on a non - exclusive basis to install, construct and maintain
improvements within the City's Chancery Park Drive right -of -way within the corporate
limits of the City, as the same now exists or may hereafter be extended or altered, for the
b purpose of installing trees, shrubs and flowers, and the construction or installation of
pergolas, pavers, benches and similar features.
The conditions of the License shall be as contained in the License Agreement attached
i hereto, and incorporated herein, as Exhibit "A ".

f a BE IT FURTHER ORDAINED by the City Council of the City of Fairfax that the City
i Manager is authorized and directed to execute the License Agreement, subject to the
concurrence of the City Attorney.

i l This ordinance shall become effective as provided by law.
