R-11-05 City Council City of Fairfax RESOLUTION NO. R -11 -05 APPROVAL RESOLUTION TO APPROVE THE REQUEST BY G. EVAN PRITCHARD, ATTORNEY /AGENT, FOR CH REALTY III /OLD TOWN VILLAGE LLC, OWNER/APPLICANT, FOR A SPECIAL EXCEPTION PURSUANT TO CITY CODE SECTION 110 -158 TO REDUCE THE AMOUNT OF REQUIRED PARKING ON THE PROPERTY KNOWN AS TAX MAP PARCELS 57- 2 -43 -D2 -202; 57- 2 -43 -D3 -301; 57-2 - 43 -D4 -402; 57- 2- 43 -F1; 57- 2 -43 -B2 -201, 202, 203, 204; 57- 2 -43 -A; 57 -4 -02 -107; ALSO KNOWN AS 3925 CHAIN BRIDGE ROAD, 3950 UNIVERSITY DRIVE, AND 3980 UNIVERSITY DRIVE. WHEREAS, CH Realty III /Old Town Village LLC, Owner /Applicant, has submitted Application No. SE- 10030005 requesting a Special Exception to reduce the requirements of Section 110 -154, which defines required off - street parking. WHEREAS, City Council has carefully considered the application, the recommendation of staff, and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 110 -366 and 110 -158 for the following reasons: 1) The request will not result in increased traffic congestion or otherwise negatively impact existing traffic flow or pedestrian and vehicular safety; 2) The request will not be contrary to the objectives specified in the comprehensive plan; 3) The request is the minimum necessary to afford relief; 4) The request will not adversely impact the safety and welfare of residents living in the area; and 5) The request is in harmony with the general purpose and intent of the applicable article of Chapter 110 of the City Code. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 25 day of January, 2011, that Application No. SE- 10030005 be and hereby is APPROVED to allow the applicant the ability to reduce the amount of required parking for 10,964 square feet of requested medical office space, subject to the following conditions: 1. With the exception of the existing 3,430 square feet of medical office space in Building `D', medical office use shall be limited to 10,964 square feet; 2. The medical office space permitted for Old Town Village /Plaza shall not include surgical centers, emergency or urgent care centers, or any uses that are likely to require frequent access by ambulance. 3. Prior to occupancy of any new medical office space, the applicant shall obtain approval from the Director of Community Development and Planning of a parking signage plan designating short -term parking for visitors of retail and medical office in the parking garage. In approving the signage plan, the Director shall assure that a minimum of five percent (5 %) and not to exceed 100 parking spaces shall be reserved for retail use with two -hour time limits.
