2010-25 ORDINANCE NO. 2010-25 AN ORDINANCE TO AMEND THE ZONING MAP OF THE CITY OF FAIRFAX, VIRGINIA TO RECLASSIFY FROM I -2, INDUSTRIAL, TO C -2, RETAIL COMMERCIAL THE PROPERTY IDENTIFIED AS 3900 PICKETT ROAD AND FURTHER DESCRIBED AS CITY OF FAIRFAX TAX MAP PARCEL 58 -3 -14 -001. WHEREAS, Trans Unlimited LLC, by Eric Snyder, agent, submitted applications No. Z- 10030016 and SE- 10060018 requesting a change in the zoning classification from I -2, Industrial to C -2, Retail Commercial, with special exceptions, for the parcel identified above, and more specifically described as follows: Beginning at a point on the east side of Pickett Road, State Route #665, a corner to Burton & Robins Inc.; Thence, with a curve to the right having a radius of 979.93 feet, an arc distance of 61.05 feet, a chord bearing N10 °20'35 "W a distance of 61.04 feet to a point of compound curve; Thence, with a curve to the right having a radius of 2908.79 feet, an arc distance of 114.98 feet, a chord bearing N09 °58'38 "W a distance of 114.97 feet; Thence, N41 °40'25 "E, a distance of 47.98 feet to a point in the south right -of -way line of Mathy Drive; Thence, with said street N74° 16'41 "E a distance of 155.61 feet to the corner of Lot 3 -B; Thence, with the west line of Lot 3 -B S15 °43'19 "E, a distance of 227.94 feet; Thence, departing Lot 3 -B and running with the property line of Burton & Robins S81 °28'32 "W, a distance of 214.95 feet to the point of beginning, containing 43,221 square feet (0.992 acres); and WHEREAS, the City Council has carefully considered the application, the recommendation of the Planning Commission and staff, and the testimony received at public hearing; and WHEREAS, the City Council has determined that the proposed rezoning is proper and in accordance with the Comprehensive Plan as well as with the pertinent provisions set forth in the Code of Virginia and the Code of the City of Fairfax, Virginia; NOW, THEREFORE BE IT ORDAINED, that the above described property be rezoned from I -2, Industrial to C -2, Retail Commercial. The Zoning Administrator of the City is hereby directed to modify the Zoning Map to show the changes in the zoning of these premises, and the Clerk of the Council is directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administrator, and to the Planning Commission of this City as soon as possible. This ordinance shall be effective as provided by law.
