R-10-33RESOLUTION NO. R-10-33 A RESOLUTION TO ADOPT AND DIRECT THE IMPLEMENTATION OF LOCAL GUIDELINES PURSUANT TO THE PUBLIC-PRIVATE EDUCATION FACILITIES AND INFRASTRUCTURE ACT OF 2002, FOR THE CITY OF FAIRFAX, VIRGINIA WHEREAS, the Virginia General Assembly, pursuant to authority granted under the Public-Private Education Facilities and Infrastructure Act of 2002 (Virginia Code Section § 56-575.1 together with a. amendments thereto) (the "PPEA") has mandated that there is a public need for timely acquisition, design, construction, improvement, renovation, expansion, equipping, maintenance, operation, implementation, o installation of a wide range of projects for public use; and WHEREAS, existing methods of procurement may not adequately and completely, and efficiently, satisfy such public need; and WHEREAS, financial and other incentives exist under state and federal tax provisions that encourage public entities to enter into partnerships with private entities to develop qualifying projects; and WHEREAS, authorizing the development or operation of certain qualifying projects may result in such projects being undertaken and completed in a more timely or less costly manner, which is in the public interest; and WHEREAS, prior to requesting or considering a proposal for a qualifying project under the PPEA, the City must adopt and make publicly available guidelines sufficient to comply with the PPEA, which guidelines must encourage competition, be reasonable and comply with the express provisions of the PPEA, and serve as a guide for selection and administration of projects under the P PEA. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Fairfax, Virginia, hereby formally approves, adopts and implements the "City of Fairfax, Virginia Guidelines for the Implementation of the Public-Private Education Facilities and Infrastructure Act of 2002" in the form attached to this resolution. The motion to adopt the resolution was approved on July 27, 2010.
