R-10-20RESOLUTION NO. R-10-20 APPROVAL RESOLUTION TO APPROVE THE REQUEST BY TURNPIKE LLC, OWNER, FOR SPECIAL EXCEPTIONS FOR RELIEF FROM THE DEVELOPMENT STANDARDS SET FORTH IN 10 SECTIONS OF THE CITY ZONING ORDINANCE ON THE PROPERTY KNOWN AS TAX MAP PARCEL 58-03-02-028 AND ALSO KNOWN AS 9500-9580 MAIN STREET. WHEREAS, Molly Novotny, as Agent for Turnpike LLC, Owner, has submitted Application No. SE-09110011 requesting Special Exceptions to: 1. Provide a reduced tree canopy coverage of 4.3-percent where 10-percent is required by City Code Section 110-255(1); 2. Modify the interior parking lot landscaping requirements of City Code Section 110- 259 a(2) a through f to provide islands not meeting the dimensions of planting requirements; 3. Modify the perimeter parking landscaping requirements of City Code Section 110- 259a(1) a, b, and c to allow as little as zero feet of landscaped buffer; 4. Provide a 8.7-percent open space where a minimum of 25-percent is required by City Code Section 110-783 (4); 5. Provide a zero-foot separation between proposed parking and a building where a minimum of six feet is required by City Code Section 110-153 (3); 6. Modify the requirements of City Code Section 110-180 (b)(2)a 2 ii to allow building mounted signage on walls that are not defined as building-frontage, to allow signage exceeding one-square foot per each linear foot of building frontage, and to allow total cumulative sign area to exceed 100 square feet; 7. Modify the requirements of City Code Section 110-180 (b)(2) a. 1. to allow a shopping center identification sign to include tenant names and to exceed 50 square feet in sign area to allow a maximum of 240 square feet; 8. Modify the requirements of City Code Section 110-181 (b) to allow a ground mounted sign of a maximum height of 20 feet where a there is a six-foot maximum height limitation; 9. Modify the requirements of City Code Section 110-153(6) to allow parking lot lighting at a total height of 23 feet where the maximum height is limited to 20 feet, and to allow lighting to be located in planting islands; and 10. Modify the requirements of City Code Section 110-153(2) to allow parking areas without curb delineation; and WHEREAS, City Council has carefully considered the application, the recommendation from Staff, and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exceptions with some limitations would be appropriate because the proposal would meet the requisites established by City of Fairfax Code Sections 110-366, 110-158, 110-185, 110-263, and 110- 783(6), and for the following reasons: 1. The request is consistent with the comprehensive plan and other adopted city goals and policies; 2. The request is appropriate given the size and shape of the lot and the lot's site design on which the use is proposed; 3. The request will not result in increased traffic congestion or otherwise negatively impact existing traffic flow or pedestrian and vehicular safety; 4. The request will not be contrary to the objectives specified in the comprehensive plan; 5. The request will not adversely impact adjacent property or the surrounding area; 6. The request will not adversely impact the safety and welfare of residents living in the area; and 7. The request is in harmony with the general purpose and intent of the applicable article of Chapter 110 of the City Code. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 25th day of May, 2010, that Application No. SE-09110011 be and hereby is APPROVED, as requested with the following conditions: 1. Development of the property shall be in substantial conformance with the application submitted and attached plans stamped "Received May 18, 2010," and as each may be revised to reflect these conditions of approval and as each may be revised to reflect Board of Architectural Review action with respect to the proposed architecture building materials, colors, textures and significant landscape features; 2. The pylon sign advertising "Goodyear" shall be removed when the current occupant vacates the space; 3. The design and overall size of the near ground mounted sign should be as generally described as option one subject to administrative and architectural review approval. The base of the sign shall be enclosed to incorporate a planter into the sign design. The base shall be constructed of materials that are consistent with or complimentary to the fagade of the future renovated shopping center. 4. The proposed wall signs on the proposed bank shall be limited to the east and northeast facing walls with a combined maximum of 150 square feet of sign area, provided however, that the TD Bank logo may be incorporated into the south wall in brick as discussed.
