2010-05ORDINANCE N0.2010-OS AN ORDINANCE AMENDING CHAPTER 102, ARTICLE II, SECTIONS 102.32,102-33,102-34(A),102-34 (D),102-34(E),102-34 (H), 102-34 (I), AND MISCELLANEOUS TEXT OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, INCREASING WATER AND SEWERSERVICE AVAILABILITY CHARGES BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that Sections 102.32, 102-33, 102-34 (a), 102-34 (d), 102-34 (e), 102-34 (h), 102-34 (i), and miscellaneous text of the Code of the City of Fairfax, Virginia, is amended to read in its entirety as follows: Sec. 102-32. -Water connection fees, availability and frontage charges. Water connection fees and availability and frontage charges are hereby established as follows: (1) Connection charge. Availability Charges for turbo meters and meter sizes 2-inches and larger, and in special cases as determined by the city, shall be calculated on an individual basis as defined in section 102 of the city_ordinance. Areas of consideration in calculating the Availability Charge include typical consumption; rated capacity of the required meter; comparable use data; principal uses; and number and type of fixture units to be served. Multiuse premises shall be charged based on the various types of use or on the principal use whichever results in the higher charge. Unless otherwise stated, the type of premises and units of measurement shall be as defined in chapter 102. The term "occupancy unit" means any room or suite of rooms typically rented as a unit containing overnight sleeping accommodations which are separate from any other such room or suite of rooms within the same hotel, motel, or roominghouse. The city manager or his designees reserves the right to determine, on an annual basis, the maximum daily quantity of water used when compared to the usage determined when the Availability Charge was calculated. Fixture drain or trap size Fixture Units 1L' inches and smaller 1 1"inches 2 2 inches 3 2" inches 4 3 inches 5 4 inches 6 Availability Charges for sanitary sewer serving single family homes, detached or attached, shall be $7,247, and in special cases as determined by the city manager or his designee, shall be determined on an individual basis. Areas of consideration in calculating the Availability Charge include typical consumption; strength of the wastewater; comparable use data; principal uses; and number and type of fixture units to be served. Apartments and condominium apartments shall be 80 percent of the Single Family Availability Charge per dwelling unit. Hotel, motel, and roominghouses shall be 25 percent of the Single Family Availability Charge per occupancy unit. All other uses shall be $7,247 for the first 20 fixture units as determined by the International Plumbing Code ,editions adopted by the city at the time of the application, and $271.00 for each fixture unit over 20. The city manager or his designees reserves the right to determine, on an annual basis, the maximum daily quantity of sewage when compared to the usage determined when the Availability Charge was calculated. Usage in excess of the charge of the Availability Charge shall require an increase in the Availability Charge and at the rates at the time of the reconciliation of the Availability Charge. (2) Frontage charge: Single family (attached or detached) dwellings: Per linear foot of frontage, $6.00 with a minimum frontage charge of $300.00 and a maximum frontage charge of $600.00. Other: Per linear foot of frontage, $6.00 with a minimum frontage charge of $600.00 and with no maximum. The city manager or his designee shall reasonably determine the type of premises and charges for all premises when the premisesdoes not fall under any of the listed types. Unless otherwise stated, the type of premises and units of measurement shall be as defined in chapter 110 of this Code. The term "occupancy unit" means any room or suite of rooms typically rented as a unit containing overnight sleeping accommodations which are separate from any other such room or suite of rooms within the same hotel, motel or roominghouse. (Code 1978, § 24-2.2; Ord. No. 2000-10, ~ 24-2.2, 4-11-2000; Ord. No. 2001-3, ~ 1, 4- 10-2001; Ord. No. 2002-7, ~ 3, 4-9-2002) Sec. 102-34. -Miscellaneous charges and deposits. (a) Water service charge. A service charge of $35.OOsha11 be paid by or on behalf of each customer for the initiation of water service. A service charge of $50.00 shall be paid prior to restoration of water service after termination for nonpayment. (b) Late payment charge. In the event any utility bill is not paid in full within 25 days of the bill date stated therein, a late charge in the amount of five percent of the outstanding balance of such bill will be added thereto. (c) Payments after termination of service. In the event any utility bill is not paid in full within 45 days of the bill date stated therein, including payment of any late charges imposed pursuant to subsection (b) of this section, water service to the customer will be terminated. Water service will not be restored until payment is made in full of any outstanding utility bills, including late charges, and the service charge imposed pursuant to subsection (a) of this section. (d) Water service deposit-Residential customers. A water service deposit of $40.OOmust be paid by or on behalf of each residential customer for the institution of any new water service. (e) Same-Commercial customers. A water service deposit of $40.00, or the amount of one month's service charges, as estimated by the city, whichever amount is greater, must be paid in advance by or on behalf of each commercial customer prior to the institution of any new water service. (~ Same-Retention by city; interest payment to customer. The city will retain the water service deposits made pursuant to subsection (d) and (e) of this section until such time as payment in full is received for the "final utility service bill," at which time the deposit will be refunded to the customer together with simple interest thereon at the rate of five percent per annum. The city shall be deemed to have complied with the requirements of this subsection if the amount of such deposit, together with the interest thereon, in cash, check or money order, is mailed to the last known address of the customer to whom such deposit is to be refunded. (g) Sanitary sewer television inspection service charge. A minimum service charge of $200.00 for the first two hours' work shall be paid in advance to the city by the requester of the inspection for each nonscheduled sanitary sewer line television inspection. Additional work in excess of two hours shall be charged to and payable by the requester at the rate of $100.00 per hour or fraction thereof. (h) After hours water turn on or turn off service charge. A service charge of $100.00sha11 be paid to the city in advance by the requester of such service for each instance wherein the city is requested and responds to a request to turn water on or to turn water off outside the normal city business hours. (i) Hydrant flow test service charge. A service charge of $160.OOsha11 be paid to the city in advance by the requester for each flow test on a fire hydrant. (.1) Private fire line connection service charge. A service charge of $250.00 shall be paid to the city in advance by the requester of the connection for the right to connect a private fire line to the city water system and for the inspection of the connection. (k) Water transmission main crossing agreements/licenses service charge. A charge of $500.00 shall be paid to the city in advance by the requester for each request to cross any city water transmission main where such city permission is required. In addition, the requester shall pay to the city all actual cost and expenses incurred by the city to process the request, inspect and monitor the site and the work. (Code 1978, ~ 24-2.3; Ord. No. 2002-7, ~ 4, 4-9-2002)Sec. 102-35. -Billings. All billings for water and sewer service shall be made quarterly, except those commercial consumers, who shall be billed monthly.
