RESOLUTION TO APPROVE THE REQUEST OF ALICE G. HAASE, AGENT, FOR
NORMANDY UNIVERSITY DRIVE, LLC, FOR A SPECIAL EXCEPTION,
PURSUANT TO CITY CODE SECTION 110-158, TO REDUCE THE REQUIRED
NUMBER OF PARKING SPACES FOR AN OFFICE BUILDING, ON THE
PREMISES KNOWN AS 4031 UNIVERSITY DRIVE AND MORE PARTICULARLY
DESCRIBED AS TAX MAP PARCEL 57-1 ((02))-043.
WHEREAS, Alice G. Haase, Agent, has submitted Application No. 5E-09090019 requesting
a Special Exception, pursuant to City Code Section 110-158 to modify the required number of
parking spaces so that 145 spaces may be required rather than the 160 spaces specified by the
zoning ordinance;
WHEREAS, City Council has carefully considered the application, the recommendation of
the staff and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exception is appropriate
with modifications because the proposal meets the requisites established by the City of
Fairfax Code Sections 110-158 and 110-366 for the following reasons:
1. The request will not result in increased traffic congestion or otherwise
negatively impact existing traffic flow or pedestrian and vehicular safety;
2. The request will not impact the safety and movement of vehicular traffic
upon adjacent streets;
3. The request is necessary to permit the reasonable use of the subject
property;
4. The request will not adversely impact adjacent property or the
surrounding area;
5. The request will not compromise the safety and welfare of persons
working or living in the neighborhood.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on the
12 day of January, 2010, that Application No. 5E-09090019 be and hereby is APPROVED
with the following condition:
1. The use of the building shall be limited to general office and financial institution
uses.
The motion to adopt the resolution was approved on January 12, 2010.
