R-09-08RESOLUTION R-09-08 RESOLUTION TO APPROVE THE REQUEST BY THE CITY OF FATRFAX, OWNER, FOR A SPECIAL EXCEPTION PURSUANT TO CITY CODE SECTION 110-179<b)(2~ TO ALLOW AN ILLUMINATED SIGN WITHIN 100 FEET OF A RESIDENTIAL DISTRIC"f ON THE PROPERTY KNOWN AS 3730 OLD LEE HIGHWAY AND FURTHER IDENTIFIED AS TAX MAP PARCEL 57-2-CC2~~-175A AND ON THE PROPERTIES KNOWN AS 3722 AND 3708 OLD LEE HIGHWAY AND FURTHER IDENTIFIED AS TAX MAP PARCELS 57-2-<(2~~-175 AND 57-2-~<2)~-176. WHEREAS, The City of Fairfax, Owner, has submitted Application No. SE-09020008 requesting a Special Exception to allow an illuminated sign within 100 feet of a residential district in accordance with Section 1 1 O- 1 79. WHEREAS, City Council has carefully considered the application, the recommendation from Staff, and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception, if modified by the conditions herein, would be appropriate because the proposal meets the requisites established by City of Fairfax Code Section 1 10-366 for the following reasons: The purposes of zoning ordinances set forth in the Code of Virginia, § 15.2-2283. 1 J The request is consistent with the comprehensive plan and other adopted city goals and policies; 2J The request is appropriate given the size and shape of the lot and the lot's site design on which the use is proposed; 3) The request will not result in increased traffic congestion or otherwise negatively impact existing traffic flow or pedestrian and vehicular safety; 4J The request will not be contrary to the objectives specified in the comprehensive plan; SJ The request will not adversely impact adjacent property or the surrounding area; . 6J The request will not adversely impact the safety and welfare of residents living in the area; and 7J The request is in harmony with the general purpose and intent of Article II of Chapter 1 1 O of the City Code. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 28th day of April, 2009, that Application No. 5E-09020008 be and hereby is APPROVED, as requested with the following conditions: 1. All development shall conform to the Hughes Group Architects design development plans dated 6 February 2009, revised through 28 April 2009 as submitted with the application. 2. The applicant shall, prior to Site Plan approval, add coniferous vegetative screening to all sides of the area designated `proposed mechanical farm' as so labeled on the proposed Architectural Site Plan detail. 3. The applicant shall work with the County of Fairfax to reach a mutually-agreeable solution to any realigr~rnent of the existing pedestrian path that connects the adjacent off-site Belle Willard parking area with the proposed expansion of the southern portion of the western parking area between the proposed community center and the existing police station. 4.
