AN ORDINANCE GRANTING A LICENSE TO, AND AUTHORIZING THE CITY
lVI:ANAGER TO EXECUTE A LICENSE AGREElVI:ENT ""ITH, TCG VIRGINIA.

TFlE CITY OF FAIRFAX, VIRGINIA FOR TFlE CONSTRUCTION, OPERATION,
lVI:AINTENANCE, REPAIR AND UPGRADE OF ITS TELECOlVl:lVI:UNICATIONS
FACILITIES FOR THE PROVIDING OF TELECOlVl:lVI:UNICATIONS SERVICES
BE IT ORDAINED BY TFlE CITY COUNCIL OF TFlE CITY OF FAIRFAX.
VIRGINIA that TCG VIRGINIA. INC.. and its successors. for a period of five (5) years from
the date of full execution of a License Agreement substantially of the form attached to this
ordinance", and subject to the conditions and restrictions contained therein" is hereby
authorized and empo'-'Vered on a non-exclusive basis to construct", maintain", operate,. remove"
relocate or replace its Telecommunications Equipment under and through the public right-of-
vvay vvithin the corporate limits of the City of Fairfax, Virginia, as the same llOVl.T exists or may
hereafter be extended or altered, for the purpose of providing Telecommunications Services.
The conditions of the License shall be as contained in that certain License Agreement
attached to this Ordinance.
BE IT FURTHER ORDAINED by the City Council of the City of Fairfax that the
City :M:anager is authorized and directed to execute a License Agreement containing the terms
and conditions contained herein and substantially of the form attached to this Ordinance"
subject to such reasonable modifications as approved by the City Attomey.
This ordinance shall become effective as provided by la"-V.
