A SPECIAL EXCEPTION PURSUANT TO CITY CODE SECTION 110-158 TO ALLOVV A REDUCTION OF THE REQUIRED PARl<.ING FROlVI 160 SPACES TO 108 SPACES ON THE PRElVIISES ~OVVN AS TAX lVIAP PARCEL 47-3-01-040 AND ALSO ~OVVN AS 3616 JER.lVIANTOVVN ROAD AND CUR.R.ENTLY CLASSIFIED AS INSTITUTIONAL IN THE COlVIPR.EHENSIVE PLAN FUTURE LAND USE lVIAP. VVHEREAS, The City of Fairfax, has submit:t:ed Application No. SE08050023 requesting the Special Exceptions to the City Codes listed belovv: Section 110-155 Required off-street parking. ~HER.EAS, City Council has carefully considered the application, the recommendation of the staff.. and testimony received at the public hearing; and V\THEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Sections 1 "10-158 and 110-366 far the follovving reasons: 1) The request vvil1 not result in increased traffic congestion or othervvise negatively impact existing traffic flovv or pedestrian and vehicular safety;. 2) The request vvill not be contrary to the objectives specified in the comprehensive plan;. 3) The request is necessary to permit the reasonable use of the subject property;. 4) The request vvill not adversely impact adjacent property or the surrounding area; 5) The request is the minimum necessary to afford relief;. 6) The request vvill not adversely impact the safety and vvelfare of residents living in the area;. and 7) The request is in harmony vvith the general purpose and intent of the applicable article of this chapter. NOVV, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 24 day of June 2008, that Application No. SE-08050023 be and hereby is APPROVED, as requested per the follovving conditions: 1. All improvements shall be in substantial conformance vvith. the Generalized Development Plan dated June 3, 2008; 2. All field lighting shall be tumed offno later than 11 :00 pm; and 3. The replacement "trees on the G-ainsborough Court Apartments site shall be planted at a size expected to equal or exceed the canopy percentage being removed vvithin five years of installation.
