VVHEREAS, Farrish of Fairfax, INC., has submitted Application No. SE-08030012 requesting the Special Exceptions to the City Codes listed belovv: Section 110-153 Driving lanes located immediately adjacent to structures shall be separated from su.ch structure by a side~alk,. landscaped strip,. or combination thereof not: less than four Teet in vvidth. VVhere parking spaces are contiguous to a structure,. such landscaped strip or sidevvalk shall be not less than six feet in vvidth. Section 110-783 A minimum of 25 percent of the gross area of the lot shall be landscaped open space. Section 110-259 Each off-street: parking area not: adjacent to the right-of-vvay shall be separated from the property line by a landscaped strip of not less than the '-Vidth of the required setback for the zoning district 'VVithin Vv'"hich such parking area is located, or 12 feet in vvidth, Vv'"hichever is less, provided that a minimum of seven feet in vvidth shall be provided. Each off-street parking area Vv'"hich is adjacent to a public right-of-'-Vay shall be separated from such right-of Vv'"ayby a lar1dscaped strip of not less than "the Vv'"idth oT the required building restriction area for the zoning district '-Vithin Vv'"hich such parking area is located. Section 110-259 At least one planting island Vv'"ith minimum dimensions of nine feet by I 8 feet shall be provided for every 12 parking or loading spaces proposed. Each required planting island shall be landscaped Vv'"ith a deciduous tree Vv'"hich meets the dimensional requirements established in subsection (a)( 1) of this sectioTl. Section 110-155 Motor vehicle sales, lease and rental: One space for every vehicle displayed for sales, lease or rental, plus one space for every 500 square feet of enclosed display floor area, plus one space for every 2,500 square feet of open sales/rental display lot area, plus two spaces for each service bay, plus one space for every 250 square feet of gross floor area for office or garage. WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Sections 110-366, 110-263 and 110-158 for the following reasons: 1) The request will not result in increased traffic congestion or otherwise negatively impact existing traffic flow or pedestrian and vehicular safety; 2) The request will not be contrary to the objectives specified in the comprehensive plan; 3) The request will not result in inadequate on-site amenity; 4) The request is necessary to permit the reasonable use of the subject property; 5) The request will not adversely impact adjacent property or the surrounding area; 6) The request is the minimum necessary to afford relief; 7) Granting the request will not confer upon the applicant any special privileges that are denied by this division to other property owners who are subject to its provisions and who are similarly situated; 8) The request is in harmony with the purpose and intent of this division and is not of substantial detriment to water quality; 9) The request is not based upon conditions or circumstances that are self-created or self-imposed; and 10) Reasonable and appropriate conditions are imposed, as warranted, that will prevent the allowed activity from causing a degradation of water quality. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 9 day of December 2008, that Application No. SE-08030012 be and hereby is APPROVED, as requested with the following conditions: 1. The proposed development shall be in general conformance with the plans by the RBA Group, stamped and dated July 7, 2008, except as modified by these conditions. 2. The landscape strip between the parking lot and the Fairfax Boulevard right-of-way and planters around sign bases shall be planted with seasonal flowers. 3. The front projection to be added to the building entrance shall be either stone, metal, or a traditional material to match the quality of the Subaru site, subject to the review and approval of the Board of Architectural Review. 4. The applicant shall either modify the entrance to allow only a right-in movement, or provide signage and pavement striping notifying drivers waiting to exit onto Fairfax Boulevard not to block the entrance.
