SECTION 1 10-185 FOR A SPECIAL EXCEPTION TO CITY CODE SECTION 1 10-
180(b)2.b.4. TO ALLOVV BUILDING-lVlOUNTED TENANT SIGNS AT A HEIGHT
GREATER THAN 3.5 FEET ABOVE THE FINISHED FLOOR LEVEL OF THE SECOND
STORY AT 3950 UNIVERSITY DRIVE, AND 3955 AND 3925 CHAIN BRIDGE ROAD,
AND 10420 ~ORTH STREET, AND lVlORE PARTICULARLY DESCRIBED AS TAX

VVHEREAS, CH Realty IIVOld Tovvn Village, LLC. has submitted Application No.
SE-07050011 requesting a Special Exception to the City Code listed belovv:
Section 110-180(b)2.b.4.
On multi-story buildings" no
tenant sign shall be permitted at a
height greater than 3.5 feet above
the finished floor level of t:he
second story.
~EREAS,. City Council has determined that the proposed Special Exception is
appropriate because the proposal meets the requisites established by City of Fairfax Code
Section 110-185 and Section 110-366(3) for the follovving reasons:
The applicant" s proposal,
1) Is consistent: vvith the recommendations of the Comprehensive Plar1;
2) 1'v1eets the purpose of the sign code for signage that: is adequate and not: excessive;
3) Provides signage that is compatible vvith the architecture of the principal use; and
4) Requests the minimum relief necessary.
NOVV, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 26nd day of June 2007, that Application No. SE-07050011 be and
hereby is APPROVED, vvit:h the follovving development conditions:
1. The applica.n..t shall ensure that sig::nage for Old Tovvn Village is consistent
vvith the approved master sign pla.n.. dated J-une 8, 2007 ar:1d as modified by the
recommendations of the Board of Architectural Revievv.
2. The applica.n..t: shall ensure that all other signage complies vvith the standards
of the City Code unless special exceptions are gran.ted by City Council.
