RESOLUTION TO APPROVE THE REQUEST BY DEBBIE :KEATING AGENT.
FOR A SPECIAL EXCEPTION TO CHAPTER 110 110-180 ((a)) OF THE CITY
CODE ON THE PRElVIISES ~OVVN AS 10330 lVIAIN STREET. AND lVIORE
PARTICULARLY DESCRIBED AS TAX lVIAP PARCEL 57-4-02-119-A.
V\THEREAS, Debbie Keating agent, has submitted Application ~o. SE-07050013 requesting a
Special Exception, pursuant to City Code Section 110-180 ((a)) 1:0 alIo,"", t:vvc> multiple tenant
sig:ns along the frontage or Old Lee Highvvay on t:he property knovvn as :l'\.Ilain Street :rrv1:arket
Place;
"\N'"HEREAS, City Council has carefully considered the application, the recommendation or
the starr, and the testimony received at the public hearing; and
~HEREAS, City Council has determined that the proposed Special Exception is appropriate
vvith modifications because the proposal meets the requisites established by the City or
Fairfax Code Sections 110-366 and 110-185 rar the fol1ovv-ing reasons:
1) The existing building facing Old Lee High,","ay substantially blocks from vie'\.V" all signage
for tenants facing lVIain Street;
2) The proposed signage vvould help pedestrians along Old Lee Highvvay, and North Street to
find the shops behind the obstructing building;
3) The proposed signage is not anticipated to arrect the safety a.nd movement of vehicular
traffic on the subject property a.nd along lVIain Street; and
NOVV, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this
day of September 25, 2007, that Application SE-07050013 be and hereby is APPROVED,
VVITH THE FOLLOVVING CONDITIONS:
1) The additional signage shall be accomplished ,","ith up to tvvo 83 square-root multiple
tena.nt sign;
2) The design or the signage shall be submitted to the Board of Architectural Revievv for
final approval prior to installation. During its revie,"," the BAR. shall determine the
appropriate background a.nd letters that ,","ould be able to be visible at night vvith
contrasting background and lettering.
