R-06-11 A RESOLUTION SETTING TFJ:E ALLOCATION PERCENTAGE FOR PERSONAL PROPERTY TAX RELIEF IN TFJ:E CITY OF FAIRFAX FOR TFJ:E 2006 TAX YEAR VVHEREAS,. th..c Personal Property Tax: Rclief- Act or 1998" Code or Virginia 9958- 1 -3523 et seq., (the ''''PP~rRA'''') has been s"L1.bstantially modified by the enactment or Ch.apter 1 of the Acts OT Assembly" 2004 Special Session I (Senate Bill 5005)" ar:ld the provisions oT Itern. 503 of Chapter 951 of the 2005 Acts aT Assembly (the 2005 revisions to the 2004-06 Appropriations Act); and VVI-:IEREAS" these legislative enactments have required the City to take affirmative steps to imple1T1ent these changes" aI1d to provide for the computation and allocation. of relicf provided pursuant to the PPTR~ as revised; and VVHEREAS" the City Council" by resolution adopted on February 7" 2006 (Resolution No. R- 06-03)" implemented the chan..ges to the PPTRA effected by erlactment aT Chapter I OT the Acts or Assembly" 2004 Special Session I and of Item 503 or the 2005 Session Revisions to the 2004-06 Appropriations Act; and ~HEREAS" this resolution is adopted pursuant to the requirements of Resolution No. R-06- 03_ NO""". THEREFORE. BE IT RESOI~VED by the City Council of the City of Fairfax, as folloV'Vs: 1. That qualifying personal use vehicles V\Tith an assessed value less than or equal to $1,000.00 V\Till be eligible for 100.000/0 tax relief from personal property taxation. 2. That qualirying personal use vehicles V\Tith an assessed value greater thal""1 $1,,000.00 but less than or equal to $20,,000.00 VV'ill be eligible ror 57.420/0 tax relief rrorn personal property taxation. 3. That qualifying personal use vehicles having an assessed value of greater than $20,,000.00 shall only receive 57.420/0 tax relief from persol""1al property taxation on the first $20,,000.00 aT assessed value. 4. That all other vehicles "",hich do not meet the definition of '''qualifying'''' (including,. but not limited to,. business use vehicles,. motor l""1omes and the like) V\Till not be eligible ror any rorm ortax relief under this program. 5. That the above percentages or relief applied to the categories of q"L1-alifying personal use vehicles are estimated to Tully use all available PPTRA funds allocated to the City aT Fairrax by the CommonV'Vealth oT Virginia. BE IT FURTH.ER. RESOLVED that terms used herein that have defined mea:nings set forth in the PPTRA shall have the same meanings as set forth in Code of~ Virginia" S58. 1-3523" as amended" and to the extent that the provisions or this resolution conflict V\Tith any other provision of the lavvs orthe city,. that the provisions of this resol"L1-tion shall controL BE IT FURTI-IER RESOLVED that this resol"L1-tiol""1 shall be e.tfective as provided by luV'V.
