VVHEREAS. NRJV[ Investments, Inc, has submitted Application No. SE-815-06-1
requesting a Special Exception to the City Code listed belaV\..':
Section 110-1046(3)(a)(I) - l'V1inimum yard requirements; Front;
Interior lot. Ten reet.
"VVI-IEREAS, City Council has carefully considered the application, the
recommendation of the staff and testimon..y received at the public hearing; and
VVHEREAS, City Council has determined that the proposed Special Exception is
appropriate because the proposal meets the requisites established by City of Fairfax Code
Section 110-1046(6) ror the roUovving reasons:
1. The request to reduce the front yard setback is expected to result in site
improvements that vvill complement the unique character of the Old Tovvn Fairfax
Historic District V\rith respect to scale, placement, design a.n..d use of materials.
2_ The request to reduce the front yard setback to allovv stairs to be constructed V\Tithin the
front sidevvalk is not expected to result in an appearance vvithin the Transition Overlay
District that does not complement the historic character of Old Tovvn Fairfax.
NOVV. THEREFORE. BE IT RESOLVED by the City Councilor the City or
Fairrax on this 25th day or April 2006, that Application No. SE-815-06-1 be and hereby is
APPROVED, as requested.
