BE IT ORDAINED. by the City Council of the City of Fairfax. Virginia. that Chapter 90.
Article II", Division 5,. Section 90-139 of the Code of the City of Fairfax" Virginia,. is hereby
amended and re-enacted to read in its entirety as folloVY"s:
"'Sec_ 90-139. Applicability to rehabilitation commencing before enactment: of division;
expiration of division.
An. OV\Tner may apply for a:I1 exemption if a building permit for the proposed rehabilitation
vvas issued on or after January 1,. 1989,. and the v..rork authorized by such permit Vr.Tas
completed, as determined by the building official,. on or after January 1,. 1990. In addition,.
a:nd notvvithstanding anything to the contrary in this division or elsevv-here in applicable la-Vol",.
only exemptions granted under the provisions of this division on or prior to November 15,
2008, or for vvhich applications vvere fully and completely filed vvith the city on or prior to
that date and then subsequently granted by the city pursuant to the terms of this division,
shall be lavvful."
This ordinance shall become effective as provided by lavv.
