of Fair"'ax~ is hereby amended t:o add a nc"-V sec-tion g. as Collo"VVs:
Sec_ 110-915. Povvers and duties.
The board of architectural revievv shall have the folloVv'ing povvers and duties:
(5) For the purposes of this article and article XX of this chapter (historic overlay districts)"
article XXI of this chapter (Old Tovvrr Fairfax Transition Overlay District)" and article XXII
of this chapter (Architectural Control Overlay District), the terms "erected," .'constructed,,"

"structure," "improvement,," "features appurtenant to such structure or improvement,."

opinion of the director,. VV'ill have no more effect on the character orthe district than those
listed,. VV'hich are deemed to result in only minor effect on the character of the architect1...1Tal

similar featu.res.

These minor actions shall be subject to administrative revieVV' and decision" upon submittal of
an appropriate application pursuant to section 110-917. The director shall be guided in his
decisions by the standards and guidelines established ror revieV\i' in the comprehensive plan
and the community appearance plan and shall have authority to request modifications or a
specific proposal in order that the proposal may comply VV'ith such standards and guidelines.
The director shall refer to the board of architectural revieVV" all applications that are not
specifically placed under his purvie-vv,. or cannot be reasonably implied to be VV'ithin his
purvievv from the descrip1:ion contained in this section. The director shall issue a certificate or
appropriateness" including any conditions,. for all approved actions. If an action is disapproved
by the director,. the applicant may appeal the decision VV'ithin 30 days thereof to the board or
architectu.ral revieVV'. The director shall keep a record of decisions rendered under this section
and shall report such decisions to the board or architectural revievv at its ne:xt regular meeting.
This ordinance shall become effective as provided by law.
