AN O~INANCE AUTHORIZING THE CITY lVIANAGER TO EXECUTE AN
AGREElVIENT OF PURCHASE AND SALE ON BEHALF OF THE CITY TO SELL
CERTAIN REAL PROPERTY AND IlVIPROVElVIENTS OVVNEI> BY THE CITY AND
LOCATED AT 10435 NORTH STREET. TO ASPEN GROVE INVESTlVIENTS. LLC
V\7HEREAS, the City of Fairfax is the oV'Vuer of certain real property, together '\Nith
improvements thereon. located at 10435 North Street in the City (Tax IVIap No. 57-4-02-106);
and
"V\7I-IEREAS, the City Council has determined that it is in the best interest of the City to
negotiate and enter into an .Agreement of Purchase and Sale ""ith Aspen Grove Investments"
LLC, and to sell the property.
NOVV. THEREFORE. BE IT ORDAINED by the City Council of the City of Fairfax.
Virginia, that the City l\t1anager is authorized to execute an Agreement: of Purchase and Sale
on behalf of the City "VV"ith Aspen Grove Investments, LLC, for the real property and
improvements located at 10435 North Street, in substantially the form of the draft .Agreement
of Purchase and Sale attached to this ordinance at Attachrr1ent: 1,. and to conclude settlement
pursuant to the terms of the Agreement of Purchase and Sale_
BE IT FURTIIER ORDAINED, that the City l\I1:ar1ager is authorized to make any changes or
amendments to the form of the lease, provided that the amendments are acceptable to the City
l\Ilanager and approved as to form by the City Attomey_
