AN ORDINANCE ~NDING AND REENACTING SECTION 98-1, AR.TICLE I,
CHAPTER. 98, OF THE CODE OF THE CITY OF FAIR.FAX, VIRGINIA,
CONCER.NING INCOR.POR.A TING BY R.EFERENCE INTO THE CITY CODE
CER.TAIN STATE CODE PR.OVISIONS R.ELATING TO THE STATE JVJ:OTOR
VEHICLE LA VVS, DRIVING JVJ:OTOR. VEHICLES VVHILE INTOXICATED, AND
DISPOSITION OF SUCH CASES FOR JUVENILES.
BE IT ORDAINED, by the City Council of the City of Fairfax, Virginia, upon revievv or
the ar=encb:=ents made to Title 46.2, and Article 2 (Section 18.2-266, et seCl.) of Chapter 7 of
Title 18.2. Article 9 (Section 16.1-278. et seCl.) of Chapter 1 1 of Title 16.1 of the Code of
Virginia during the 2007 session of the Virginia General Assembly,. that Section 98-1 of the
Code of the Ciry of Fairfax be and the sa.:rn.c is hereby a.rnended and reenacted to read as Iollcn..-vs:
Sec.9g-1. Adootion of state laVV"_
Pursuant to the authority of Section 46.2-1313 of the Code of Virginia,. 1950, as
amended, all of the provisions and requirements ofllie lavv-s oIthe state contained in Title 46_2 of
the Code of Virginia. Article 2 (Section 18.2-266, et seCl.) of Chapter 7 of Title 18.2 of the Code
of Virginia. and Article 9 (Section 16.1-278. et seCl.). of Chapter II of Title 16.1 of the Code of
Virginia" all of the provisions and requirements of such lavvs as in force and effect on Ju.ly 1"
2007, except Section 46.2-114, aI1d except those provisions a.r1d requirement.s the violation or
vvhich constitutes a relony, are hereby adopted a.r1d ir1corporated in this chapter by reference and
made applicable ~ithin the city as fully as though set forth at length herein. It shall be unlaV\l"ful
ror any person ~ithin the city to violate or fail, neglect or refu.se to comply ~ith any of the
incorporated provisions of Title 46.2 or Article 2 (Section 18.2-266, et sea.) of Chapter 7 of Title
18.2 or Article 9 (Section 16.1.278. et seCl.), of Chapter 11 ofTitIe 16.1 of the Code of Virginia
-vvhich are adopted by this section; provided, that in no event shall the penalty imposed ror the
violation of ar1Y provisions or requirements hereby adopted exceed the penalty imposed for the
offense under Title 46.2 or under Article 2 (Section 18.2-266, et sea.) of Chapter 7 of Title 18.2
or nnder Article 9 (Section 16.1-278. et seCl.) of Chapter 11 ofTitIe 16.1 of the Code of Virginia.
This Ordinance shall become effective immediately.
