AN ORDINANCE AlV1ENDING CHAPTER 58, ARTICLE 11 AND III OF THE CODE OF THE
CITY OF FAIRFAX. VIRGINIA. PERTAINING TO PARI< AND RECREATION ADVISORY
BOARD AND P ARl< OPERATING POLICY_
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX.
VIRGINIA (hereinafter referred to as "CITY") that Chapter 58, Article II and Article III
of the Code of the City of Fairfax, Virginia", are hereby amended in their entirety and shall
read as follovvs:

Sec. 58-31. Est:ablished.
There is hereby established an Advisory Board to Ci"ty Council to be lcr1o"YVn as the Parks and
Recreation Advisory Board, othe~ise kr10vv as PRAl3.

Sec... 58-32. Composit:ion; appoint:ment: and 'terms DC oCfice DC members.
(a) The Parks and Recreation Advisory Board shall consist of fourteen members selected as
nearly as possible from the various groups vvithin the city having an. interest in parks,
trails, indoor and outdoor recreation facilities, recreation programs, and special events
(Fall Festival, July 4t.h, etc.). Seven members of the Advisory Board shall be appointed by
the city council. The eighth member is a member of the ~orthem Virginia Regional Park
Authority, as designated by City CounciL The ninth member shall be a member of the
Seniors" Center Advisory Council, as designated by City CounciL The tenth member
shall be a member of the Community Appearance Committee ~ho is designated by the
Committee. The eleventh member shall be a member of the Commission of the Arts vvho
is designated by the Commission. The tvvelfth member shall be a member of the City
School Board V\l'ho is designated by the Board. The thirteenth member shall be a member
of the Planning Commission vvho is designated by the Commission. The fourteenth
member shall be a nonvoting., advisory representative of the city's teen counciL The
Director of the Parks and Recreation Department shall serve as a non-voting, ex-officio
member to the Advisory Board. l"\.1:embers of the board shall serve at the pleasure of the
City Councilor for three years, vvhichever is shorter.
(b) The Parks and Recreation Advisory Board meets on the second Thursday of the months
September through July. Occasionally, a special meeting not held at the regular time may
be called. In an effort to stress the importance of meeting, Board members vvho miss
three regular meetings vvithin this eleven-month period vv-ill be presumed to have
resigned, and the Advisory Board Chair vvill notify the City Clerk in vv-riting, requesting
advertisement to fill the vacancy. ConsideratioI1 for extenuating circumstances vvill be
given on an individual basis.

Sec. 58-33. R.esponsibili1::ies generally.
(a) The Advisory Board shall serve as the advisory body for the City of Fairrax City
CounciL The Advisory Board shall serve as liaison to the City Council bet~een the
Parks and Recreation Department and citizens of the City of Fairfax. The Advisory
Board shall consult with and advise said bodies in matters affecting parks, trails,
indoor and outdoor recreation facilities, recreation programs, and City-sponsored
special events, including promotion, marketing, membership, programming, planning,
fee structures, naming of park entities, and maintenance, and to input its long-range
planning for resources for capital projects for rehabilitation, design and/or
development for indoor/outdoor recreation.
(b) The Parks and Recreation Advisory Board shall ensure adequate coordination of all
matters affecting policy of joint community use of schools with the City School Board
in accordance with agreements between the City Council and the School Board.
(c) The Parks and Recreation Advisory Board is advisory in nature only and will have no
authority for operations.
(d) In rendering advice or making recommendations to City Council as to program,
acquisition, or development, the Advisory Board shall also give consideration as to
methods of implementing and financing, after consultation with the City Manager.
Particular attention shall be given to such projects as are applicable for inclusion in
the Capital Improvement Plan of the City.
( e) Notwithstanding any of the other provisions of this Article, any matter recommended
by the Parks and Recreation Advisory Board to the City Council that has a financial
implication will be forwarded to the City Manager for his comments prior to
consideration by the City Council.

Sec. 58-34. Recommendations.
(a) Facilities. The Parks and Recreation Advisory Board shall be charged with studying and
recommending on parks, trails, and indoor and outdoor recreation facilities, specifically:
(1) Geographical distribution of parks, trails, and indoor/outdoor recreation facilities within
the community according to the needs of the community and as measured against national
standards which have been developed.
(2) Participation by the City in regional facilities and the benefits or inadequacies as indicated
thereby.
(3) Specific plans for the development of parks, trails, and indoor/outdoor recreation
facilities, provided that the Advisory Board shall ensure full consultation with the
Planning Commission on matters affecting the comprehensive plan.
(4) Specific plans for the maintenance of parks, trails, and indoor/outdoor recreation facilities.
(5) Specific plans for the acquisition and development of open space for the purposes of
parks, trails, and indoor/outdoor recreation facilities.
(6) Specific plans for the Capital Improvement Plan as it relates to parks, trails, and
indoor/outdoor recreation facilities.
(7) Specialized recreation needs not being met by either public or private development.
(8) The joint community use of school facilities.
(9) The naming of parks, trails, and indoor/outdoor recreation facilities.
(10) The rules and regulations for the operations of City's parks, trails, and
indoor/outdoor recreation facilities.
(b) Programs. The Parks and Recreation Advisory Board shall be charged with studying and
recommending on the recreation programs, specifically:
(1) Recreation programs services being provided with particular reference to variety and age
groups.
(2) Programs made available to city citizens by the county recreation department.
(3) Publicity undertaken to make known to citizens available opportunities of both the city
and the county.
(4) The annual program offerings and level of staffing as represented by the budget
document.
(5) The activities of volunteer organizations in the various fields of recreation. .
(c) Special Events. The Parks and Recreation Advisory Board shall be charged with studying
and recommending on City-sponsored special events, specifically:
(1) Special events being provided with particular reference to variety and age groups.
(2) Specific plans for creating new special events.
(3) Specific plans for modifying existing special events, including cost and structures,
marketing, promotion.

Sec. 58-35. Coordination of activities of volunteer agencies.
The Parks and Recreation Advisory Board shall be responsible for recommending park, trail,
playground development, and recreational activity. It shall encourage volunteer citizen
participation to the maximum extent possible.

Article III. PARK OPERATING POLICY
Sec. 58-61. Park regulations.
(a) The City Council may establish, by ordinance, rules and regulations for the operation of
the City's parks, trails, and indoor and outdoor recreation facilities. The rules and
regulations shall be made available in convenient public facilities throughout the City, and
available to any person upon request. The City Council may require the rules and
regulations, or portions thereof, to be posted at one or more of the City's parks.
(b) It shall be unlawful for any person to violate any park rule or regulation. Any such
violation shall be a class 4 misdemeanor.

Sec. 58-62. Closed areas.
Any section or part of any park or trail or indoor/outdoor facility may be declared closed to
the public by the City Manager at any time or for any interval of time, either temporarily or at
regular and stated intervals, daily or otherwise, and either entirely or merely to certain uses, as
the City Manger shall find reasonably necessary.
