PE:RT AINING TO A SE:RVICE FEE FO:R T:RANSPO:RT BY FI:RE DEPA:RTJVl:ENT EJVl:E:RGENCY JVl:EDICAL SE:RVICES VE:H:ICLE BE IT ORDAINED, by the City Conncil of the City of Fairfax, Virginia, that Chapter 42 of the Code of the City of Fairfax, Virginia, is hereby amended to add thereto a ne'-V Article VI, vvhich shall read in its entirety as Iollo'VV's: C:H:APTE:R 42. A:RTICLE VI. SE:RVICE FEE FO:R T:RANSPO:RT BY FI:RE DEPA:RTJVl:ENT EJVl:E:RGENCY JVl:EDICAL SE:RVICES VE:H:ICLE Sect:ion 42-1.41.. Service Charge. (1) Except as othervvise provided by Section 42-145 of this Chapter, a service fee for Basic Life Support (BLS), Advanced Life Support Levell (ALS 1), Advanced Life Support Level 2 (ALS2) and a ground transport mileage fee is imposed on each person being tral:1sported by any emergency medical services vehicle that is operated or maintained by the City Fire Department" Fairfax Volunteer Fire Department Inc. or for """""hich a permit has been issued to the City by the Virginia Office of Emergency I\..1:edical Services. The term '"""'emergency medical services vehicle'" has the definiticH:1 specified in Virginia Code ~ 32.1-111.1. (2) The fee rates shall be determined by the City and established vvithin the current schedule of Rates ar1d Levies. Such fees shall be revie~ed on a periodic basis as determined by the City l\IIanager. Sect:ion 42-142. Disbursement: oC Funds. (1) Except as noted beloVitl'" in Sectiorl 42-142 (2), the funds received from the payment orthis fee shall be paid into the general fund of the City to aid in defraying the cost of providing such service. (2) A percentage of the fee collected shall be distributed to the Fairfax Volunteer Fire Department, Ir1c. (FVFD) to assist in defraying the capital cost:.s of emergency vehicles and facilities oVitl'"r1ed by FVFD. The percentage shall be negotiated betvveen the City and the FVFD. Sect:ion 42-143. Definit:ions. The folloVitl'"ing definitions shall apply to ambulance fees: (I) Baszc Life Suppor~ (1~L.s~: Services shall be medical treatment or procedures to a patient as defined by the National Emergency :M:edicine Services (E1\I1:S) Education and Practice Blueprint for the Emergency I'\lledical Technician ~ Basic (ElV[T). (2) Advanced Life Supponr, Lever 1 rALS1.): Services shall be medical treatment: or procedures provided to a patient: beyond the scope of an E:rv1:T- Basic as defined by the National E:M:S Education and Practice Blueprint. (3) Advanced Life Supporr. Lever 2 rALS2.): Services shall be defined as advanced life support (ALS) services provided to a patient including one or more of the follo~ing medical procedures: (i) defibrillation/cardioversion; (ii) endotracheal intubation; (iii) cardiac pacing; (iv) chest decompression; (v) intraosseous line, and/or (vi) the administration of three or more medications. (4) Ground Transport Mileage GTM: Mileage shall be assessed in statute miles from the location of the incident to a hospital or other facility where a patient is transported. Only miles traveled with the patient on board shall be considered billable miles. (5) Determination of Fee Rates: As used in this section, allowable ambulances fees for Advanced Life Support 2 (ALS2) transports shall be determined based upon the current Medicare definition. Section 42-144. Authority. The City Manager is hereby authorized and directed to establish rules and regulations for the administration ofthe fees imposed by this section, including, but not limited to, payment standards for those persons who demonstrate economic hardship. Section 42-145. Exemptions. No fee shall be imposed on persons in the following instances: (1) Persons determined to be medically indigent by the City in accordance with administrative policies established by the City Manager; (2) Persons affected by fire, flood, storm, natural or man-made calamity or disaster, or by widespread public disturbance or disorder when an emergency medical services vehicle responds as a matter of City policy without call; or (3) Persons transported pursuant to any no-charge mutual aid agreement with another jurisdiction.
