AN ORDINANCE AUTHORIZING "QUICI<;;: TAI-CE" CONDElVINATION
PROCEEDING FOR THE ACQUISITION OF A UTILITY EASElVIENT/RIGHT OF

VV"I-IEREAS, the City has undertaken to underground certain utilities located in Old
To~n Fairfax; and
VVI-IE:R.EAS, the City has determined that there is a public need for a utility
easement/right of V\TUY of approximately 1000 square feet on a portion of property oVv'"ned by
Cou.rthouse Professional Center Condominium Association, located in the 3900 block of
University Drive, and having Tax :N1ap No. 57-2-((22))-20 (the "Property"), and the City and
the O'\..V"uer have been rmable to reach agreement on the valuation for such acquisition; and
"VVI-IEREAS., due to the deadlines imposed in conjunction V\Tith the undergrourrding
proj eel., the initiation of condemnation proceedings utilizing "quick take" procedures is
necessary.
NO"'"', THEREFORE, BE IT ORDAINED, by the City Council or the City or
Fairfax" Virginia, that condemnation utilizing "quick take" procedures of approximately 1 000
square feet of the Property for the purpose of a utility easement/right ofvvay agreement is
necessary, for the reasons set forth in this ordinance, and staff is hereby authorized to initiate
condemnation proceedings, including possession prior to the institution of the condemnation
proceedings, in. accordance VV"ith the lavv--.
Thi s ordinance shall become effective as provided by lavv--.
