A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO SETTLE THE
LAWSUIT AGAINST THE CITY AND THE ZONING ADMINISTRATOR BY
THOMAS AND ANN MAICHAK
WHEREAS, a lawsuit was filed by Thomas and Ann Maichak ("Maichak") against
the City, the Zoning Administrator, the Farrcroft Homeowner's Association, and Chin Loh
and Cynthia Chau ("Lohs"), relating to the construction of a deck on the Loh property in
Farrcroft; and
WHEREAS, the Lohs filed a cross-bill against the City, the zoning Administrator,
and the Farrcroft HOA: and
WHEREAS, the parties have reached a settlement agreement that will result in the
dismissal of the lawsuit and the cross-bill with respect to all parties.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Fairfax, Virginia, that the city Attorney is authorized to settle the lawsuit against the City and
the Zoning Administrator by Thomas and Ann Maichak, and the cross-bill against the City
and the Zoning Administrator filed by Chin Loh and Cynthia Chau, an that the City Attorney
is authorized to execute any and all documents on behalf of the city and the Zoning
Administrator in connection with the settlement.
