R-05-36 A RESOLUTION TO INITIATE CONDEMNATION PROCEEDINGS FOR APPROXIMATELY 2.02 ACRES OF PROPERTY HAVING AN ADDRESS OF 10610 MOORE STREET, TAX MAP NUMBER 57-1-19-B-005, OWNED BY THE HEIRS OF JOHN RICHARD RATCLIFFE, MARY BAYARD RATCLIFFE, JANE C. RATCLIFFE, ANN MARIA RATCLIFFE, CHARLES THEODORE RATCLIFFE, AND GEORGE WILLIAM RATCLIFFE, FOR PUBLIC PARK PURPOSES. WHEREAS, the City has determined that there is a public need for a public park on approximately 2.02 acres of property, having an address of 10610 Moore Street, on property owned by the heirs of John Richard Ratcliffe, Mary Bayard Ratcliffe, Jane C. Ratcliffe, Ann Maria Ratcliffe, Charles Theodore Ratcliffe, and George William Ratcliffe, devisees of Charles Ratcliffe per will dated November 24, 1833, and recorded in Superior Court Will Book 1, Page 104; and WHEREAS, in order to proceed with the acquisition of the property for public park purposes, the initiation of condemnation proceedings is necessary. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax that condemnation of a certain property having an address of 10610 Moore Street, Tax Map No. 57-1-19-B-005, which property is owned by the heirs of John Richard Ratcliffe, Mary Bayard Ratcliffe, Jane C. Ratcliffe, Ann Maria Ratcliffe, Charles Theodore Ratcliffe, and George William Ratcliffe, devisees of Charles Ratcliffe per will dated November 24, 1833, and recorded in Superior Court Will Book 1, Page 104, is necessary for the purpose of public park land, and staff is hereby authorized to initiate condemnation proceedings, including possession prior to the conclusion of the condemnation proceedings, if necessary, in accordance with the law. ADOPTED this 14 day of June, 2005.
