20050727 R-05-58RESOLUTION R-05-58 RESOLUTION TO APPROVE THE REQUEST OF THE CITY OF FAIRFAX, BY ROBERT L. SISSON, CITY MANAGER, FOR SPECIAL EXCEPTIONS TO CHAPTER 110 OF THE CITY CODE TO ALLOW AN EXPOSED WALL HEIGHT OF 45 FEET (NORTH FACE OF GARAGE) AND 48 FEET (NORTH FACE OF BUILDING A) WHERE THE MAXIMUM PERMITTED HEIGHT IS 43 FEET, TO ALLOW A FLOOR AREA RATIO OF 1.7 (INCLUDING THREE LEVELS OF ABOVE GRADE PARKING) WHERE THE MAXIMUM PERMITTED IS 1.2 AND TO PERMIT A FRONT SETBACK OF 1.5 FEET WHERE 10 FEET ARE REQUIRED ON THE PREMISES KNOWN AS 3925 AND 3951 CHAIN BRIDGE ROAD AND 3950, 3960 AND 3970 UNIVERSITY DRIVE, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCELS 57-2- ((2))-165, 165A, 167A, 167C AND 57-4-((2))-120. WHEREAS, The City of Fairfax has submitted Application No. SE-802-05-1 requesting Special Exceptions to the City Code listed below: Section 110-1046(2) - Maximum building height. No wall of any structure shall be exposed more than 43 feet above the finished grade. (3) - Minimum yard requirements. Comer lot. Each structure shall be separated from the right-of-way by a sidewalk at least ten feet in width. (5) - Floor area ratio. If structured parking is provided on the lot appurtenant to a permitted use, the total of the gross floor area of the buildings and the above- grade horizontal surface area of the structured parking lot shall not exceed 70 percent of the gross lot area. WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because the proposal meets the requisites established by City of Fairfax Code Sections 110-1046(6), 110-1047 and 110-366 for the following reasons: 1. The proposal is consistent with the recommendations of the Comprehensive Plan. 2. It is not expected to have any negative impact on adjacent properties 3. It is not expected to significantly increase traffic volumes or congestion, and 4. The proposal is consistent with the purpose and intent of the Old Town Fairfax Transition Overlay District. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 26th day of July, 2005, that Application No. SE-802-05-1 be and hereby is APPROVED.
