20050726 2005-14ORDINANCE NO. 2005-14 AN ORDINANCE TO AMEND THE ZONING MAP OF THE CITY OF FAIRFAX, VIRGINIA TO RECLASSIFY FROM R-2 AND R-3, RESDENTIAL, AND OLD TOWN FAIR.FAX TRANSITION OVERLAY DISTRICTS, TO R-M, MULTIFAMILY, AND OLD TOWN FAIRFAX TRANSITION OVERLAY DISTRICTS, "THE PROPERTY" IDENTIFIED AS CITY OF FAIRFAX TAX MAP PARCEL 57-2-((2))-166 AND ALSO KNOWN AS 3915 CHAIN BRDGE ROAD. WHEREAS, at its meeting of July 12, 2005, the City Council adopted a resolution to initiate a change in zoning of the property identified above, and more specifically described as follows: Beginning at a point being the northwest comer of 3900 University Associates, Trustee, as acquired in Deed Book 4532 at Page 487, among the land records of Fairfax County, Virginia, said point also being on the southern right-of-way line of Whitehead Street, 50 feet wide; thence departing said point and running with the western line of said 3900 University Associates the following courses and distances South 05°31'00" East 230.02 feet to a point; thence South 08047'08'' West 92.88 feet to a point being the northeast comer of Industrial Development of the City of Fairfax, Trustee, as acquired in Deed Book 9334 at Page 562, among the land records of Fairfax County, Virginia; thence departing said point and running with the northern line of said Industrial Development South 82017'04'' West 214.80 feet to a point on the eastern right-of-way line of Chain Bridge Road, width varies; thence departing said point and running along the eastem right-of-way line of said Chain Bridge Road North 07042'56'' West 318.90 feet to a point of intersection of Chain Bridge Road and Whitehead Street; thence departing said point and running along the southern line of said Whitehead Street North 82017'04'' East 250.00 feet being the point of beginning containing 76,751 square feet or 1.76196 acres, more or less; and WHEREAS, the City Council has carefully considered the application, the recommendation of the Planning Commission and staff, and the testimony received at public hearing; and WHEREAS, the City Council has determined that the proposed rezoning is proper and in accordance with the Comprehensive Plan as well as with the pertinent provisions set forth in the Code of Virginia and the Code of the City of Fairfax, Virginia; NOW, THEREFORE BE IT ORDAINED, that the above-described property be rezoned from R-2 AND R-3, Residential and Old Town Fairfax Transition Overlay Districts, to R-M Multifamily and Old Town Fairfax Transition Overlay Districts. BE IT FURTHER ORDAINED, that the above conditions, application package and general development plan be approved. The Zoning Administrator of the City is hereby directed to modify the Zoning Map to show the changes in the zoning of these premises, including the existence of the conditions, and the Clerk of the Council is directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administrator, and to the Planning Commission of this City as soon as possible. This ordinance shall be effective as provided by law.
