20040427 2004-3ORDINANCE NO. 2004-03 AN ORDINANCE TO AMEND THE EXISTING GENERAL DEVELOPMENT PLAN AND PRELIMINARY SITE PLAN APPROVED IN CONJUNCTION WITH ORDINANCE NO. 1975-19, WHICH REZONED FROM R-2 TO C-PD 9.361 ACRES OF LAND LOCATED IN THE 3300 BLOCK OF PICKETT ROAD, AS IT PERTAINS TO THE PROPERTIES LOCATED ON TAX MAP PARCEL 58-2-((10))-1, AND ALSO KNOWN AS 9420-9497 SILVER KING COURT (MANTUA PROFESSIONAL CENTER). WHEREAS, by Ordinance No. 1975-19, adopted on May 13, 1975, the City Council approved the rezoning of 9.3691 acres of land located in the 3300 Block of Pickett Road from R-2 to C-PD; and WHEREAS, The New School of Northern Virginia, Inc., by Keith C. Martin, Attorney/Agent, submitted application No. Z-797-03-1, requesting an amendment to the general development plan and preliminary site plan approved in conjunction with the above- referenced rezoning as it pertains to the properties located on Tax Map Parcel 58-2-((10))-1, and also known as 9420-9497 Silver King Court (Mantua Professional Center); and WHEREAS, the City Council has carefully considered the application, the recommendation of the Planning Commission and staff, and the testimony received at public hearing; and WHEREAS, the City Council has determined that the proposed amendments to the general development plan and preliminary site plan are proper and in accordance with the Comprehensive Plan as well as with the pertinent provisions set forth in the Code of Virginia and the Code of the City of Fairfax, Virginia. NOW, THEREFORE BE IT ORDAINED, that, based on the public convenience, welfare, and good zoning practice, the request of The New School of Northern Virginia, Inc., for an amendment to the above-referenced general development plan and preliminary site plan to reflect the creation of Parcels lA, lB and lC and to revise the site layout for Parcel lB to allow the addition of a 10,764 square foot building, as shown on the Amended General Development Plan, dated October 2003, and revised through April 5, 2004, and Preliminary Site Plan, dated January 30, 2004, and revised through March 11, 2004, for the properties located on Tax Map Parcel 58-2-((10))-1, and also known as 9420-9497 Silver King Court (Mantua Professional Center) is hereby approved for the reasons stated in the staff report and subject to the following development conditions: The applicant shall revise the Preliminary Site Plan to provide one-way traffic circulation for the school addition that eliminates the potential for conflicting vehicle movement and allows vehicles to load and unload passengers without blocking traffic on the main drive aisle through the office complex. The hours of use for the playing field and patio area behind the building addition shall be limited to school days from 9AM to 5PM and shall not include the use of amplification equipment. The applicant satisfies Planning Commission concerns about water drainage on the subject property and that the City will seek input from Fairfax County regarding drainage. 4. The applicant continues to work to ensure the integrity and effectiveness of the buffer between the site and the residential community. 5. The applicant shall ensure that the following commitments are satisfied in a timely manner subject to review and approval by the Zoning Administrator: a. The New School drainage engineer will return as soon as possible to discuss stormwater drainage details (with the residents of 3214 Prince William Drive). Co do Neighbors will be provided a construction superintendent's name and phone number prior to commencement of construction. The architect will lower the building addition's roof peak by approximately three feet. Storage of dirt, construction material and equipment will be located as far away from the rear property line as feasible. Nelly Stevens holly trees shall be planted at the rear wall of the "black box" area. The New School will pay for or contract to install a drainage system within the rear of the lot located at 3214 Prince William Drive. This system may be installed by a qualified contractor selected by residents of 3214 Prince William Drive through reasonable, competitive bid. This system will be installed before the commencement of cleating and grading activity for the New School's proposed building addition, and the applicant shall ensure that the system is repaired in the event of damage resulting from construction activity for the New School's proposed building addition. The Zoning Administrator of the City is hereby directed to modify the Zoning Map to show the changes in the zoning of these premises, including the existence of the conditions, and the Clerk of the Council is directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administrator, and to the Planning Commission of this City as soon as possible. This ordinance shall be effective as provided by law.
