AN ORDINANCE AMENDING SECTION 110-79(a)(7)(c),
ARTICLE II, DIVISION 3, CHAPTER 110
OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA.
BE IT ORDAINED, by the City Council of the City of Fairfax, that Section 110-
79(a)(7)(c), Article II, Division 3, Chapter 110 of the Code of the City of Fairfax,
Virginia, is hereby replaced in its entirety as follows:
Sec. 110-79(a)(7)(c).
Facilities provided to reduce nonpoint source pollution in runoff, as required
under subsection (a)(7)a. or (a)(7)b. of this section, shall be provided on-site;
however, the Director of Public Works may approve the payment of a fee to
the City in lieu of on-site detention. Such fee shall be used for the
construction and/or maintenance of one or more public facilities to be located
at the discretion of the city. The amount of the fee shall be based on the
projected nutrient load from the development site, the cost of design and
construction of the facility(les), any land acquisition costs, and facility
maintenance.
The ordinance shall become effective as provided by law.
