AN ORDINANCE AMENDING SECTION 110-782(a)(8)(n),
ARTICLE XIV, CHAPTER 110 OF THE
CODE OF THE CITY OF FAIRFAX, VIRGINIA
TO EXTEND THE SUNSET DATE OF SECTION 110-782(a)(8)
TO OCTOBER 1, 2004.
WHEREAS, it is consistent with the intent and purpose of the comprehensive plan
and the zoning ordinance to provide opportunities for economic development activities;
and
WHEREAS, the potential to lease excess parking from nearby businesses and park
new vehicles in those excess spaces would expand the limited areas of vehicle storage
space available within the City; and
WHEREAS, many of the City's automobile dealerships suffer from inadequate
space for the automobiles in their inventories; and
WHEREAS, customers shopping for automobiles bring substantial business to the
City; and
WHEREAS, it is important to establish appropriate standards and conditions for
allowing off-site parking for vehicles offered for sale by automobile dealerships;
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Fairfax, that
Section 110-782(a)(8)(n), Article XIV, Chapter 110 of the Code of the City of Fairfax,
Virginia, is hereby replaced in its entirety as follows:
Sec. 110-782(a)(8)(n).
The provisions in subsection (a)(8) of this section to allow, by special use permit,
leased off-site parking of new vehicles offered for sale by automobile dealerships in
the C-2 district shall sunset on October 1, 2004.
The ordinance shall become effective as provided by law.
