20001212 2000-31ORDINANCE NO. 2000- 31. AN EMERGENCY ORDINANCE AMENDING SECTION 98-1, ARTICLE I, CHAPTER 98 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, CONCERNING INCORPORATING BY REFERENCE INTO THE CITY CODE CERTAIN STATE CODE PROVISIONS RELATING TO THE STATE MOTOR VEHICLE LAWS, DRIVING MOTOR VEHICLES WHILE INTOXICATED, AND DISPOSITION OF SUCH CASES FOR JUVENILES. BE IT ORDAINED, by the City Council of the City of Fairfax, Virginia, Article I, Chapter 98, Section 98-1 of the Code of the City of Fairfax, Virginia, is hereby amended by deleting the first sentence and substituting a new first sentence, as follows: Sec. 98-1. Adoption of state law. Pursuant to the authority of the Code of Virginia, §46.2-1313, all of the provisions and requirements of the laws of the state contained in Code of Virginia, title 46.2, Code of Virginia, §18.2-266 et seq., and Code of Virginia, §16.1-278 et seq., all of the provisions and requirements of such laws as are in force and effect on October 1, 2000, except Code of Virginia §46.2-114, and except those provisions and requirements the violation of which constitutes a felony, are hereby adopted and incorporated in this chapter by reference and made applicable within the city as fully as though set forth at length in this section. BE IT ORDAINED, by the City Council of the City of Fairfax, that an emergency exists in that the failure to immediately amend and reenact this section of the City Code will impede the ability of the City to enforce the laws of the Commonwealth of Virginia incorporated by reference therein. BE IT ORDAINED, by the City Council of the City of Fairfax, that the remaining portions of the section hereby amended shall continue as previously enacted. This ordinance shall become effective as provided by law.
