AN ORDINANCE TO AMEND CHAPTER 26 OF THE CODE OF THE
CITY OF FAIKFAX TO MODIFY ARTICLE XII AND ARTICLE XIII
TO PERMIT PHARMACIES WITH DRIVE-THROUGH FACILITIES
IN THE C-l, C-2 AND C-3 ZONING DISTRICTS WITH A SPECIAL
USE PERMIT FROM THE CITY COUNCIL.
WHEREAS, pharmacies with drive-through facilities are not permitted within any
of the City's zoning districts, while drive-through uses of greater impact are currently
permitted appurtenant to restaurants, financial institutions and automobile laundry
facilities; and
WHEREAS, pharmacies with drive-through facilities will provide a benefit to the
public while generating little, if any additional impact; and
WHEREAS, pharmacies with drive- through facilities are appropriate uses in the
City's commercial districts;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Fairfax, Virginia, that Article XII, Sec.26-167 of the Code of the City of Fairfax,
Virginia, is hereby amended with the addition of subsection 26-167 (a) (4) as follows:
(4) drive-through facilities for accessory pharmacies that meet the criteria contained in
Sec. 26-166 (k).
BE IT FURTHER ORDAINED that Article XIII, Sec. 26-172 of the Code of the City of
Fairfax, Virginia, is hereby amended with the addition of subsection 26-172 (a) (7) as
follows:
(7) Drive-through facilities for pharmacies.
This ordinance shall become effective as provided by law.
