19971209 1997-19ORDINANCE NO. 1997 - 19 AN ORDINANCE AMENDING SECTIONS 12-4, 12-6(b) AND 12-9(a), ARTICLE I, CHAPTER 12 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA CONCERNING LICENSES. BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that Sections 12-4, 12-6(b) and 12-9(a), Article I, Chapter 12 of the Code of the City of Fairfax, Virginia are hereby amended to read, in their entirety, as follows: Sec. 12-4. License taxes not applicable to person having gross receipts of ~:,.u,^~ u.,..~.~.~ ten thousand dollars or less Der vea_r. license tax shall be imposed on any person whose gross receipts for the immediately preceding year from a business, profession or occupation subject to licensure are less than ,..~ ...................... ~**, ....... /ten thousand dollars ($10,000.00)._ _ Sec. 12-6. License required; application for license; extensions of time to file application for license; corrections to application for license. (b) Each persons,,,,j,,w"s':~' +^,,, ,.~ ..,,.,.,.,.,~: ..... +n~,,~_ shall apply for a license prior to beginning business if such person was not subject to licensure in the City on or before January 1 of the license year, or no later than January 31 of the license year if such person had been issued a license for the preceding year. The application shall be on forms prescribed and furnished in duplicate by the commissioner of the revenue. Such forms shall be accurately and fully completed and executed by the applicant and shall contain such information as may be required by the commissioner of the revenue. ~ for a license must be filed in accordance with this chapter regardless whether a license tax is due or the license tax is not applicable to a business, profession or occupation. 12-9. Failure to obtain license unlawful; penalties. a) It shall be unlawful for any person to conduct or engage in any business, employment, profession, occupation or calling in the city for wF.:.ck a F. cenae :.: ..... :~ s.., a.:~ .~.~..,~ without first obtaining from the city the license required by this chapter. Except as otherwise provided herein, any person violating this section shall, upon conviction thereof, be guilty of a class 1 misdemeanor. Any person who engages in a business in the city without obtaining a license, or after being refused a license, shall not be relieved of the tax imposed by this chapter. 2. BE IT FURTHER ORDAINED that it is the intention of the city council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared invalid by the valid judgment or decree of a court of competent jurisdiction, such invalidation shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this Ordinance. 1997-19 -2 This ordinance shall become effective as provided by law.
