AN ORDINANCE GRANTING A DEED OF
EASEMENT TO BELL ATLANTIC-VIRGINIA,
INC. TO USE A FIFTEEN FOOT WIDE
STRIP OF THE CITY HALL PROPERTY
ADJACENT TO THE CHAIN BRIDGE ROAD
RIGHT-OF-WAY FOR A PERIOD ENDING ON
JULY 19, 2012, FOR THE PURPOSE OF
CONSTRUCTING , OPERATING ,
MAINTAINING, REPLACING AND REMOVING
A COMMUNICATION SYSTEM CONSISTING OF
BURIED CABLES, CONDUIT, BURIED
WIRES, POSTS, TERMINALS, LOCATION
MARKERS AND OTHER APPURTENANCES.
BE IT ORDAINED, by the City Council of the City of
Fairfax, Virginia, that the City of Fairfax hereby
grants, conveys, and quitclaims to Bell Atlantic-
Virginia, Inc. a non-exclusive easement on the property
known as City Hall, 10455 Armstrong Street, Fairfax,
Virginia, Tax Map No. 057-04-02-00-0013-A, for a period
commencing on the date the easement document is executed
by the city manager of the City of Fairfax and ending on
July 19, 2012, to construct, operate, maintain, replace
and remove a communication system consisting of buried
cables, conduit, buried wires, posts, terminals, location
markers and other appurtenances.
The terms and conditions of such easement are as
described on the attached document entitled "DEED OF
EASEMENT" and the extent of the easement is a shown on
the plat attached thereto.
BE IT FURTHER ORDAINED by the City Council of the
City of Fairfax that the city manager is authorized and
directed to execute a Deed of Easement from the City to
Bell Atlantic-Virginia,Inc., such easement to be in a
form substantially the same as that attached to the staff
report with revisions acceptable to the city manager and
approved as to form by the city attorney.
This ordinance shall become effective as provided by
law.
