AN ORDINANCE AUTHORIZING THE CITY
MANAGER, ON BEHALF OF THE CITY OF
FAIRFAX, VIRGINIA, TO EXECUTE A DEED
AND ALL DOCUMENTS NECESSARY TO CONVEY
TO THE COMMONWEALTH OF VIRGINIA, THE
CITY'S INTEREST IN 0.01 ACRES, MORE
OR LESS, OF REAL ESTATE LOCATED ON
TWO PROPERTIES ADJACENT TO ROUTE 29/50
(LEE HIGHWAY) BETWEEN EATON PLACE AND
DRAPER DRIVE TOGETHER WITH A PERMANENT
EASEMENT FOR THE PROPER CONSTRUCTION
AND MAINTENANCE OF A TRAFFIC SIGNAL AND
TEMPORARY CONSTRUCTION EASEMENTS FOR
STATE HIGHWAY PROJECT 0029-151-F03, RW201.
BE IT ORDAINED by the City Council of the City of
Fairfax, Virginia, that the City Manager is hereby
authorized to execute a deed (the "Deed"), approved as to
form by the City Attorney, necessary for the City of
Fairfax, Virginia (the "City") to convey to the Commonwealth
of Virginia (the "Commonwealth"), for the consideration of
One Dollar ($1.00), the City's fee simple interest in 0.01
acres, more or less, (the "Property") of real estate owned
by the City and further described as Tax Map Parcel Numbers
48-3--((2))-4C and 47-4-((3))-A, which Property is needed by
the Commonwealth for the widening of State Route 29/50 (Lee
Highway) for State Highway Project 0029-151-F03, RW201. The
Property is further described as Parcel 009, as shown on
sheet 9, and Parcel 021, as shown on sheets 6 and 7, of the
Route 29/50 State Highway Project 0029-151-F03, RW201,
prepared by Espey, Huston & Associates and most currently
revised by VDOT on November 5, 1994 (the "Plan").
BE IT FURTHER ORDAINED that, by the Deed, the City
shall convey to the Commonwealth the permanent right and
easement to use additional areas shown on the Plan,
containing 0.03 acres, more or less, required by the
Commonwealth for the construction and maintenance of a
traffic signal, and ~he temporary right and easement tc use
additional areas shown on the Plan, containing 0.33 acres,

more or less, for the construction of cut and/or fill
slopes.
BE IT FURTHER ORDAINED that the City Manager is
authorized to execute all other documents as may be
necessary to convey the Property and the easements described
herein to the Commonwealth.
This ordinance shall become effective as provided by
law.
