19951024 1995-25 1995-25 ORDINANCE NO. AN ORDINANCE CONSENTING TO THE VACATION BY DEED OF VACATION OF TWO WATER LINE EASEMENTS PREVIOUSLY GRANTED TO THE CITY OF FAIRFAX, VIRGINIA, AS A CONDITION OF SITE PLAN APPROVAL OVER PROPERTY OWNED BY INOVA HEALTH SYSTEM SERVICES DESCRIBED AS TAX MAP PARCEL NUMBER 57-4-((2))-13C BE IT ORDAINED by the city Council of the city of Fairfax, Virginia that, pursuant to Virginia Code S15.1-480.1(1), the City of Fairfax consents, by written instrument attached hereto and made a part hereof, to the vacation of two water line easements each of ten (10) feet in width previously conveyed by Commonwealth Doctors Hospital, Inc., to the City as a condition of site plan approval by Deeds of Easement (Agreement) dated May 6, 1966 and recorded on August 19, 1966 among the land records in the Fairfax County circuit Court Clerk's office in Deed Book 2808 at Page 113. One such easement was subsequently relocated by Agreement between Commonwealth Doctors Hospital, Inc. and the city of Fairfax, dated April 29, 1970 and recorded on May 28, 1970 among the land records in the Fairfax County Circuit Court Clerk's office in Deed Book 3303 at Page 147. Such easements to be vacated are more fully described in a certain Deed of Vacation, attached to this Ordinance between the city of Fairfax, Virginia, Grantor, and Inova Health System Services, Grantee and the plat attached thereto. BE IT FURTHER ORDAINED that the terms of such vacation are described in the above-referenced Deed of Vacation which the City Manager is hereby authorized and directed to execute on behalf of the City in a form substantially the same as the form attached hereto, provided that such Deed of Vacation is approved as to form by the city Attorney.
